Common use of Arbiter of Disputes Clause in Contracts

Arbiter of Disputes. The Design Professional shall interpret and decide matters concerning performance of the District and Contractor under the requirements of the Construction Documents on written request of either the District or Contractor. The Design Professional's response to such requests shall be made with reasonable promptness and within any time limits agreed upon. The Design Professional's decisions on claims, disputes or other matters, including those in question between the District and Contractor, except for those relating to aesthetic effect as provided in Section 3.7.17.3 ‘Aesthetic Effects’, may be subject to arbitration as provided in this Agreement and in the Construction Documents.
