Common use of ARBITRATION BINDING Clause in Contracts

ARBITRATION BINDING. Any controversy or claim arising out of or relating to this Agreement, or the breach hereof, shall be settled by arbitration under the rules of the NASD in effect at that time. If the NASD refuses jurisdiction, or the Parties mutually agree in writing, the arbitration procedure described herein shall be used. In either event, the decision of the arbitrator(s) shall be final and judgment upon the award rendered may be entered in any court having jurisdiction thereof.
