Arrearage. Seller reserves all claims and causes of action against --------- tenants and others who are in arrears or who shall be obligated to pay monies in the future which are for the benefit of Seller, and Buyer shall provide its reasonable cooperation to Seller in pursuing such arrearage. Buyer shall use reasonable efforts to collect all sums in arrears as of the closing Date due to Seller, but shall not be required to commence or prosecute any litigation. Seller may not commence and prosecute litigation against any tenant for rents in arrears as long as such tenant remains a tenant of the Property, unless the statute of limitations will expire within the succeeding sixty (60) day period. To the extent that Buyer receives payments from tenants for sums due prior to the Closing Date, which can be verified based upon invoices or other applicable xxxxxxxx, such payments, including rents, shall be promptly remitted by Buyer to Seller.
Arrearage. Seller shall make and monitor all shipments and deliveries in accordance with the shipment schedules specified in K-C’s shipping instructions. When Seller becomes aware that it may be unable to ship any quantity of Pulp hereunder in accordance with K-C’s specified delivery schedule, Seller shall immediately notify K-C both orally and in writing of this possibility, and the parties shall determine whether Seller can effect delivery to meet K-C’s requirements. If, after discussion with Seller, K-C reasonably determines, in its sole good faith judgment, that Seller will not be able to make a delivery in time to meet K-C’s requirements, K-C shall have the right to obtain delivery of the required quantities of Pulp from an alternate supplier. In the event that K-C is required to purchase Pulp from another supplier pursuant to this Section 5.02, Seller shall pay K-C the difference between the higher price paid by K-C for Pulp on the open market and the price K-C would have paid to Seller if Seller had supplied Pulp as required by this Agreement, plus liquidated damages equal to ten percent (10%) of such difference, in lieu of any other direct, indirect, incidental, special or consequential damages arising from such failure to deliver. Purchases by K-C of Pulp from another supplier pursuant to this Section 5.02 shall be deducted from K-C’s Annual Purchase Obligation and Seller’s Annual Supply Obligation.
Arrearage. As of the date of this Agreement, the total amount that is owed for administrative costs, staff costs, and attorney’s fees is Four Thousand One Hundred Forty-Six and 54/100 Dollars ($4,146.54 (the “Arrearage”). The total amount of fines is Twenty-One Thousand Five Hundred and 00//100 Dollars ($21,500.00) (the “Fines”). Subject to the County approval and Owner’s performance under this Agreement, the Fines will be waived as part of the release of lien. The total amount of the Lien is Twenty-Five Thousand Six Hundred Forty-Six and 54/100 Dollars ($25,646.54).
Arrearage. Owner acknowledges that the sum of Nine Hundred and Twenty and No/100 Dollars ($920.00) (the “Arrearage”) is due and owing to the County attributable to administrative costs and attorney’s fees.
Arrearage. By submitting a response to this Solicitation, a vendor shall be deemed to represent that it is not in arrears in the payment of any obligation due and owing the State of Maryland, including payment of taxes and employee benefits, and that it shall not become so in arrears during the term of the contract if solicited for contract award.
Arrearage. If LESSEE is in arrears in the payment of any amounts due hereunder, LESSEE waives LESSEE’S right, if any, to designate the items to which any payments made by LESSEE are to be credited, and LESSOR may apply any payments notwithstanding any designation or request by LESSEE as to the items to which any such payments shall be credited.
Arrearage. The County and Owner acknowledge and agree that the total amount of the Lien since it was recorded is Four Thousand Seven Hundred Eighty-Eight and 80/100 Dollars ($4,788.80). The County acknowledges receipt of a payment of Six Hundred Sixty-Four and 99/100 Dollars ($664.99) from Owner. As such, as of the date of this agreement, the remaining total amount that is owed for the administrative costs, staff costs, attorney’s fees, and fines is Four Thousand One Hundred Twenty-Three and 81/100 Dollars ($4,123.81) (the “Arrearage”). The total amount of the fines is Three Thousand Two Hundred Seventy-Five and No/100 Dollars ($3,275.00) (the “Fines”). Subject to County approval and Owner’s performance under this Agreement, the County will agree to waive seventy-five percent (75%) of the Fines with the remaining balance to be paid with the Remaining Arrearage (defined hereafter) as provided below. As such, Owner shall pay to the County a total of One Thousand Six Hundred Sixty-Seven and 56/100 Dollars ($1,667.56) (the “Remaining Arrearage”).
Arrearage. AT&T shall pay $11,329.63 as the fee for the holdover term from September 20, 2017 to November 20, 2017 within ten (10) days from the date of City Council approval.
Arrearage. In the event Marriott is in arrears in the payment of contributions, it shall be liable to any Host, spouse, and/or dependent for loss of benefits resulting therefore.
Arrearage. The Contractor agrees that it shall make diligent efforts to avoid becoming in arrears during the term of any Contract awarded hereunder.
