Common use of ARTICLE GRIEVANCE AND ARBITRATION Clause in Contracts

ARTICLE GRIEVANCE AND ARBITRATION. It is the mutual desire of the parties hereto that complaints of employees shall be adjusted as quickly as possible, and it is understood that an employee has no grievance until he has first given his supervisor an opportunity to adjust the complaint. If an employee has a complaint, he shall discuss it with his supervisor within three (3) working days after the circumstances giving rise to the complaint have occurred or have or ought to have reasonably come to the attention of the employee: failing settlement within one working day thereafter, it shall then be taken up as a grievance within three (3) working days following advice of the supervisor's decision; in the following manner and sequence: STEP NO. The employee, with a ▇▇▇▇▇▇▇, may present his grievance to his supervisor. The grievance shall be in writing on a grievance form approved by the Company and the Association and shall include the remedy sought and shall be sufficiently specific to identify the alleged violation of the Agreement; failing settlement the supervisor shall deliver his decision in writing within three (3) working days following the presentation of the grievance to him. For the purposes of this Collective Agreement, a grievance is defined as a difference between the parties arising from the interpretation, application, administration or alleged violation of this agreement, including any question as to whether a matter is arbitrable.
