It is the mutual desire of the parties to this Agreement that the complaint of any employee shall be resolved as promptly as possible. In the event the supervisor with whom the complaint is being discussed requests the presence of an additional managerial person or persons, the employee may, if he wishes, be accompanied by his Xxxxxxx. Within five (5) working days following the receipt of the decision under Step I, the employee shall submit the written grievance to the Executive Director or his designate. The Executive Director or his designate will meet with the Grievance Committee and review the grievance. The parties shall endeavour to convene a meeting within ten (10) working days of the submission of the grievance to this step. The Executive Director may request the presence of a consultant at this meeting as may the Union. The written decision of the Executive Director will be received within six (6) working days from the date on which the grievance meeting was convened. In the event the decision of the Executive Director is not satisfactory to the the may refer the matter to Arbitration in accordance with the provisions of this Agreement. If no written request for Arbitration is received within seven (7) working days from the date of the receipt of the decision under this Step, the grievance shall be deemed to be settled. However, it is understood that the provisions of this Section may not be used with respect to a complaint or grievance directly affecting an agenda employee or employees and that the regular grievance procedure shall not be by- passed. All agreements reached under the grievance procedure between the representatives of the subjects Employer and the representatives for the Union, shall be final and binding upon the Employer, the Union and the employees. All time limits referred to in the grievance procedures and the arbitration procedure, shall be discussedconstrued as mandatory and failure to comply with any time limits shall be deemed abandonment of the grievance or denial of the grievance as the case may be. Notwithstanding the foregoing the parties may agree to waive or extend any of the time limits established in this grievance procedure.

ARTICLE UNION REPRESENTATION. The Company agrees to recognize four (4) stewards appointed by the Union for the purpose of processing grievances arising under the terms of this Agreement and meeting with the Company in respect of same. The stewards so appointed shall elect or otherwise select constitute a Union committee of four employees; it being grievance committee. It is understood and agreed that the Chairperson no more than two (2) members of the full-time grievance committee shall be entitled to meet with the Company at any one time; The Company agrees to recognize a Union bargaining unit section may be a member committee consisting of three (3) employees from the transportation department and one (1) employee from the maintenance department. Such committee shall represent the Union at all negotiations with the representatives of the Committee. The Employer will recognize and deal with Company for the said Committee on grievances and on any other matter properly arising out purpose of amending or renewing this Agreement, including any period during which the negotiations forparties are being assisted by a Conciliation Officer, Mediator or renewal Conciliation Board; Employees who are members of this Agreementthe Union negotiating committee shall be known as Employees who are appointed to the Union grievance committee shall be known as The Company agrees that all new employees shall be introduced personally to their respective Stewards at the time of hire. The Union shall notify the Company in writing of the names of its officers and the members of its bargaining and grievance committees and of any changes herein from time to time. It is understood and agreed that the Union Representative of Local may be present with the Committee at the request of either the Union or the Employer. The Union acknowledges stewards and agrees that members of the Committee negotiators have their regular duties to perform in connection with their employment and all activities of members on behalf of the Union Committee will be carried on outside regular working hours, unless otherwise mutually agreed. Members Company and that they shall not absent themselves from work for the purpose of the Union Committee will not leave carrying out their duties responsibilities without first obtaining the permission from the Supervisor of the Department or Unit in their immediate supervisor which they are working, shall not be unreasonably withheld. It is mutually agreed that one of the duplicate copies shall be posted on the bulletin board by the Union.
