Common use of Article XII Not to Prevent Events of Default Clause in Contracts

Article XII Not to Prevent Events of Default. The failure to make a payment on account of prin- cipal of, premium, if any, or interest on the Debentures by reason of any provision of this Article XII shall not be construed as preventing the occurrence of a Default or an Event of Default under Section 6.1 or in any way prevent the Holders from exercising any right hereunder other than the right to receive payment on the Debentures.

The failure to make a payment on account of prin- cipal principal of, premium, if any, or interest (or Liquidated Damages, if any) on the Debentures Notes by reason of any provision of this Article XII shall not be construed as preventing the occurrence of a Default or an Event of Default under Section 6.1 or in any way prevent limit the Holders from exercising rights of the Trustee or any right hereunder Holder to pursue any other than rights or remedies with respect to the right to receive payment on the DebenturesNotes.
