Assess soil quality across the Property Clause Samples
This clause establishes the right or obligation to evaluate the condition and composition of soil throughout the property in question. Typically, it allows a party—often a buyer or lessee—to conduct tests or inspections to determine factors such as contamination, fertility, or suitability for intended use. By enabling thorough soil assessment, the clause helps identify potential environmental issues or development constraints, thereby reducing risk and supporting informed decision-making regarding the property.

Assess soil quality across the Property. 1). ▇▇▇▇▇▇▇ shall collect and analyze a minimum of twelve (12) soil samples from six (6) locations on the Property. Minkles shall collect one (1) surface soil sample (0-1 foot below ground surface) and one (1) subsurface soil sample (2-foot minimum depth) from each of the following locations:
a). Six (6) locations randomly spaced throughout the parking lot.
2). Unless otherwise specified above, each surface soil sample shall be analyzed for TAL-Metals (with chromium speciation to analyze for hexavalent chromium) and TCL-SVOCs. Each subsurface sample shall be analyzed for TAL-Metals (with chromium speciation to analyze for hexavalent chromium), TCL-VOCs, and TCL-SVOCs. A minimum of one (1) surface and one (1) subsurface sample from a probable impacted area shall be analyzed for the full EPA-TAL (includes cyanide) and EPA-TCL.
3). Soil quality results shall be compared to the EPA RSL Resident and Industrial Screening Levels and to the applicable Protection of Groundwater SSL.
4). All analytical methods shall be capable of achieving appropriate reporting levels as specified in Paragraph 4.A.5.d. of this Contract.
Assess soil quality across the Property. 1). TC1301 shall collect and analyze a minimum of 4 soil samples from 2 locations on the Property. TC1301 shall collect one surface soil sample (0-1 foot below ground surface) and one subsurface soil sample (2 foot minimum depth) from each of the following locations:
a). An area in proximity to the UST located on the western side of the building. The subsurface soil sample from this location shall be collected from the approximate bottom of the UST.
b). From the southern side of the building.
2). Unless otherwise specified above, each surface soil sample shall be analyzed for TAL-Metals and SVOCs. Each subsurface sample shall be analyzed for TAL-Metals, VOCs and SVOCs. The surface and subsurface soil samples collected in proximity to the UST shall be analyzed for the full EPA-TAL (includes cyanide) and EPA-TCL.
3). Soil quality results shall be compared to the EPA RSL Resident and Industrial Screening Levels and to the applicable Protection of Groundwater SSL.
Assess soil quality across the Property. 1). ▇▇▇▇▇▇▇▇ shall collect and analyze a minimum of fourteen (14) soil samples from seven (7) locations on the Property. ▇▇▇▇▇▇▇▇ shall collect one surface soil sample (0-1 foot below ground surface) and one subsurface soil sample (2 foot minimum depth) from each of the following locations:
a). One (1) composite surface sample and one (1) composite subsurface sample from the soil stockpile. Each composite sample shall be comprised of three (3) aliquots of soil.

BRI shall collect one surface soil sample (0-1 foot below ground surface) and one subsurface soil sample (2 foot minimum depth) from each of the following locations:
a). Five (5) locations distributed around the buried material in the eastern parcel.
Assess soil quality across the Property. 1). Aiken shall collect and analyze a minimum of twenty-two (22) soil samples from eleven (11) locations on the Property. Aiken shall collect one surface soil sample (0-1 foot below ground surface) and one subsurface soil sample (2 foot minimum depth) from each of the following locations:
a). Two (2) locations at the debris pile east of the maintenance shop.
Assess soil quality across the Property. 1). Park View shall collect and analyze a minimum of twenty four (24) soil samples from twelve (12) locations on the Property. Park View shall collect one surface soil sample (0-1 foot below ground surface) and one subsurface soil sample (2 foot minimum depth) from each of the following locations:
a). The tire storage area behind the Meineke Car Care Center.
b). The parking area behind the screen printing and embroidery business.
c). Around the loading area on the northeastern side of the building at ▇▇▇/▇▇▇ ▇▇▇▇▇ ▇▇▇▇ ▇▇▇▇▇▇.
