Common use of ASSET ADJUSTMENT PAYMENTS Clause in Contracts

ASSET ADJUSTMENT PAYMENTS. If, following a member of the Target Group having made an Asset Adjustment Payment within paragraph (a) of the definition thereof, NTL Holdings fails to procure that an amount equal to such an Asset Adjustment Payment is (in accordance with the other terms of this Agreement) reimbursed to that member of the Target Group on or before the date which is the earlier of: 19.14.1 ten Business Days after the date on which NTL Inc. receives a reimbursement from C&W for such an Asset Adjustment Payment; and 19.14.2 thirty Business Days after the date on which such an Asset Adjustment Payment is made, PROVIDED THAT, the aggregate amount of Asset Adjustment Payments for which members of the Target Group have not been reimbursed in accordance with this Clause 19.14 exceeds L10,000,000 (or its equivalent).
