Assigned Premises. The Contractor is leased the Premises designated in paragraphs (a) through (c) below and as shown on Exhibits "A" through "C" attached for the sole purpose of the privileges granted in Section 3.01 herein. These leased premises and facilities are collectively referred to herein as the “Premises” and are offered in an “as is” condition. The Contractor acknowledges that the Premises is not private property. The Premises is part of a public airport facility and is situated within or adjacent to a public parking facility. As such, the Premises is accessible to the public. The Authority will erect signage to direct the flow of public traffic away from the Premises, however the Authority can not guarantee that public traffic, whether on foot or vehicular, will not pass through or near the Premises. Any such public traffic shall not be considered trespassers by the Contractor and Contractor shall not be, with the respect to such public traffic, permitted to exercise any legal remedies it may have against trespassers. The Contractor shall lease all of the assigned Premises throughout the Operating Period of this Contract unless otherwise specified herein. The Authority, at its sole discretion, shall determine the exact location and dimensions of the Premises. The Authority has measured the Premises for the purpose of assigning rental charges and fees hereunder. All measurements of the Premises shall be conclusive for the purpose of calculating rental or other charges hereunder. All statements contained in this Contract or otherwise made by the Authority or by anyone on the Authority's behalf concerning any measurement relating to the Premises or any other area of the Airport are approximate only, and any inaccuracy in such statements of measurements shall not give rise to any claim by the Contractor under or in connection with this Contract. Assigned Premises. Airline shall pay the District for its use of Assigned Premises in the Terminal Building including exclusive use space, preferential use space, aircraft parking position(s), and passenger loading bridge(s). Assigned Premises. Refers to specific areas of the Airport Terminals, or elsewhere at the Airport, that are assigned (or leased to Concessionaire to occupy) and use for the purposes set forth herein. Concession may be conducted pursuant to this Agreement, including those City owned fixtures and properties therein more specifically described in Exhibit A hereto incorporated herein, which Concessionaire, at its sole cost, expense and liability may use solely in its pursuit of this Agreement and upon the terms and conditions therein provided that title thereto shall at all times be and remain in City and further provided that such fixtures and equipment shall be returned to City along with the Assigned Premises in the manner and according to the terms and conditions in this Agreement.
Assigned Premises. The Contractor shall be assigned the existing land and facilities totaling approximately 715,100 square feet as shown on Exhibit A in "as is" condition for the Contractor’s use in the operation of the FBO concession. The space and facilities assigned herein are collectively referred to as the "Premises".
Assigned Premises. County hereby assigns to Concessionaire the following premises at Airport more particularly described below and shown on EXHIBITS BXX through XXX, attached hereto and incorporated herein by this reference:
Assigned Premises. County hereby grants Operator a license to use: (i) the Kiosk Areas (if designated by Department) for the installation, operation and maintenance of Kiosks or Ground Transportation Service Desks; and (ii) the Passenger Loading Areas for the loading and unloading of Airport passengers and their baggage. Operator acknowledges and agrees that this Agreement is an agreement for services and nothing in this Agreement shall be construed as granting Operator any title, interest or estate in the Assigned Premises. Department may require Operator to provide the services required hereunder from location(s) on the Airport other than the Assigned Premises. In the event Department determines it is necessary or desirable for Operator to relocate its operations, Department shall provide thirty (30) days prior written notice to Operator of the required relocation. Operator shall, at no cost to County, relocate to the location(s) on the Airport designated by Department for its operations hereunder upon the date set forth in Department’s written notice. The Assigned Premises shall not be used for any purposes other than those specifically provided for herein.
Assigned Premises. The Assigned Premises is shown on Exhibit A. By mutual agreement of the Parties, the Assigned Premises may be modified from time to time throughout the Term of the Agreement. If modification of the Assigned Premises is required, the Director is authorized to amend this Agreement. Contractor accepts the Assigned Premises as specified herein. The Premises are assigned in “as is” condition, without any expressed or implied representation or warranties of any kind whatsoever unless specifically set forth in this Agreement.
