Common use of Assignment, novation or transfer to Spark Affiliates Clause in Contracts

Assignment, novation or transfer to Spark Affiliates. Spark may assign, novate or otherwise transfer all or part of the benefits and burdens of this Agreement to any Spark Affiliate or any third party providing services to Spark, provided that the assignee/novatee/transferee undertakes to Supplier to perform and be bound by the relevant terms of the Agreement and the assignee/novatee/transferee is not a competitor of Supplier and is able to pay any Charges as they become due and payable.
