ASSIGNMENT, TRANSFER, AND SUBCONTRACTING. Contractor may not assign, transfer, or subcontract any portion of this contract without the Department's prior written consent. (18-4-141, MCA) Contractor is responsible to the Department for the acts and omissions of all subcontractors or agents and of persons directly or indirectly employed by such subcontractors, and for the acts and omissions of persons employed directly by Contractor. No contractual relationships exist between any subcontractor and the Department under this contract.

Neither party shall assign or otherwise transfer any of the rights or delegate any of the duties set for in this Contract without the prior written approval of the other party. The Contractor shall not use this Contract, or any portion thereof, for collateral for any financial obligation, without the prior written permission of City. No such written approval shall relieve the Contractor of any obligations of this Contract and any transferee or subcontractor shall be considered the agent of the Contractor. The Contractor shall remain liable as between the original parties to the Contract as if no such assignment had occurred.

No contractual relationships exist between any subcontractor and State Arresting Agency under this Agreement.
ASSIGNMENT, TRANSFER, AND SUBCONTRACTING. 10.1 The Modulr Products provided to the Introduced Customer are personal to the Introduced Customer. The Introduced Customer may not novate, assign or otherwise transfer this Agreement, any interest or right under this Agreement (in whole or in part) without the prior written consent of Modulr.
10.2 The Introduced Customer agrees Modulr may, in its sole discretion, assign, or transfer some or all of its rights and obligations or delegate any duty of performance set out in the documents forming this Agreement. Modulr may subcontract any of its obligations under this Agreement.
10.3 In the event of any transfer of this Agreement by Modulr to another service provider; if the Introduced Customer does not want to transfer to the new provider, the Introduced Customer must notify Modulr of its objection in writing to Customer Services. On receipt of such notification, Modulr it will terminate this Agreement. Any balance remaining in the Introduced Customer’s Account(s) will be returned to the Introduced Customer in accordance with the redemption procedure set out in the Modulr Account Terms and Conditions.
ASSIGNMENT, TRANSFER, AND SUBCONTRACTING. The Assisted Business shall not assign, transfer or subcontract any portion of the Contract without the express written consent of the City and the Montana Department of Commerce. (Mont. Code Xxx. § 18-4-141.)
ASSIGNMENT, TRANSFER, AND SUBCONTRACTING. The following rules of assignment, transfer and subcontracting fully apply to this CONTRACT and the rights and obligations hereunder:
ASSIGNMENT, TRANSFER, AND SUBCONTRACTING. (a) The Grantee may subcontract any portion of this Contract to accomplish the completion of the Project. However, Grantee accepts responsibility for the adherence to the terms of this Contract by such contractors, subcontractors, or subrecipient entities and by any public or private agents or agencies to which it delegates authority to carry out any portion(s) of this Contract. The Grantee may not otherwise assign or transfer any portion of this Contract without the express written consent of the Department.
(b) The Grantee’s assignment, transfer, or subcontract of this Contract or any portion thereof neither makes the Department a party to that agreement nor creates any right, claim, or interest in favor of any party to that agreement against the Department. No contractual relationships exist between any subcontractor, assignee, or transferee and the Department.
(c) The Grantee must immediately notify the Department of any litigation concerning any assignment, transfer, or subcontract of this Contract or any portion thereof.
