Associated Partial Payment of Claim Loans. In some instances, the Prior Servicer may have completed a loss mitigation action that resulted in a partial payment of claim under the FHA contract of insurance for a Mortgage Loan. In these cases the Borrower executed a promissory note creating a secondary mortgage payable to HUD (the ―Associated PPC Loan‖). HUD does hereby transfer, assign, set over and convey, without recourse, to Purchaser, the Associated PPC Loans held by HUD, identified on Schedule I, in accordance with the same terms applicable to the Mortgage Loans as provided in Section 2.01(f). There shall be no purchase price applicable to the Associated PPC Loans. On and after the applicable Claim Date, Purchaser assumes and shall be responsible for all obligations and liabilities of HUD relating to and arising from the Associated PPC Loans.
