Association Rules the applicable obligations, rules and guidelines issued by Visa USA, Europe, Asia Pacific, Canada and other Visa regions, MasterCard International Incorporated, American Express Company or other applicable Card Associations, including, without limitation, the Visa Cardholder Information Security Program (CISP), Visa Account Information Security Program (AISP), the MasterCard Site Data Protection Program and PCI DSS. Association Rules. (a) Retailer and Bank agree that, as of the Effective Date, the initial Association for all Co-Brand Credit Cards shall be MasterCard (the “Initial Association”). Retailer further acknowledges that Bank has entered into an arrangement with the Initial Association through which Bank is obligated to maintain the MasterCard brand on the Co-Brand Credit Cards issued under the Program through September 30, 2018 (which date, or such earlier date at which Bank is no longer obligated to maintain the MasterCard brand on the Co-Brand Credit Cards issued under the Program is called the “Branding Expiration Date”), and Retailer agrees that (i) prior to the Branding Expiration Date it shall not rebrand the Co-Brand Credit Cards with the brand of any payment network (e.g., [***]) other than MasterCard, and (ii) it shall include a requirement in any credit card program agreement or other arrangement with any Nominated Purchaser which acquires the Program Assets prior to the Branding Expiration Date (which Retailer shall use commercially reasonable efforts to enforce) that such Nominated Purchaser shall maintain the MasterCard brand on the Co-Brand Credit Cards through the Branding Expiration Date.
(b) Retailer shall have the right to enter into an independent relationship with and change the Association once during the Term at any time during the [***] following the Branding Expiration Date (i) [***], to [***] or (ii) as mutually agreed by the parties, to any other Association; provided, however, that (x) such change in Association will not occur in the [***] of the Term or during any holiday IT freeze period; (y) Retailer must provide Bank with notice of its election to change the Association at least [***] the effective date of such a change; and (z) if such new Association is [***]. Upon Retailer’s request, Bank shall provide to Retailer a [***] of Retailer’s request thereof. Retailer will bear (or cause the new Association to bear) the expense for Bank’s [***]. Any financial, marketing or other support that Retailer receives from the new Association as a result of the agreement to use such new Association for payment network services for the Program shall belong entirely to Retailer, and Bank shall have no right in or to such financial, marketing or other support; provided, however, that [***].

Association Rules. The Board may, from time to time and subject to the provisions of this Declaration, adopt, amend and repeal Association Rules, provided, however, that such Association Rules (or any amendments thereto) shall not be effective as to any Lot or Tract owned by Declarant unless either (i) such Association Rules have been approved by Declarant in writing, or (ii) such Association Rules were adopted (or amended) by a Board having a majority of its members appointed by the Declarant. The Association Rules may restrict and govern the use of any area by any Owner, by the family of such Owner, or by any invitee, licensee or lessee of such Owner except that the Association Rules may not discriminate among Owners and shall not be inconsistent with this Declaration, the Articles, the Bylaws or applicable law. Upon adoption, the Association Rules shall have the same force and effect as if they were set forth in and were a part of this Declaration.
Association Rules the current and future bylaws, rules, regulations, releases, interpretations and other requirements (whether contractual or otherwise) imposed or adopted by any Association (as amended from time to time by such Association), which are applicable to the Services or other payment methods;
Association Rules. The parties acknowledge that the Visa, MasterCard and Discover Network Association Rules give Visa, MasterCard and Discover Network certain rights to require termination or modification of this Agreement with respect to transactions involving Visa, MasterCard and Discover Network Cards and the Visa, MasterCard and Discover Network Card systems and to investigate You. The parties also acknowledge that issuers of other Cards, for which we perform services on your behalf, may have similar rights under their applicable Association Rules with respect to this Agreement’s applicability to transactions involving such other Cards.
Association Rules. You agree to follow all requirements of this Agreement in connection with each Card transaction and to comply with the Visa USA Inc. Operating Regulations, the MasterCard Bylaws, and all other applicable Association Rules.
Association Rules. (a) Retailer and Bank agree that all Co-branded Credit Cards shall be MasterCard branded cards.
(b) Each of Bank and Retailer acknowledges and agrees that the Program shall be operated in accordance with the Association Rules. If and to the extent any of the terms and conditions contained in this Agreement conflict with such Association Rules, said terms and conditions shall generally be deemed to supercede the Association Rules, as between the parties hereto. If however, compliance with this Agreement would directly conflict with the Association Rules and the conflicting provision has not been worked out between Bank and the Association, this Agreement shall be deemed modified to the extent necessary to comply with such directly conflicting Association Rules. The parties further acknowledge and agree that, in the event of any such modification, the modified terms of this Agreement shall preserve, to the extent practicable, the rights and obligations of the parties as contemplated by this Agreement. If either party becomes aware of any material inconsistency between the Association Rules and this Agreement, such party shall timely advise the other party of any such inconsistency.
Association Rules. 15.1 The purchaser acknowledges that the Directors of the Association shall be entitled, at all times, to lay down rules in regard to the following matters on the estate:
15.1.1 the preservation of the environment;
15.1.2 the right to keep any animal, reptile or bird;
15.1.3 the placing of movable objects upon or outside the buildings included in the estate, including the power to remove any such objects;
15.1.4 the storing of flammable or other harmful substances;
15.1.5 the conduct of any persons within the estate and the prevention of nuisance and any nature or any owner of immovable property;
15.1.6 the use of roads, pathways and open spaces;
15.1.7 the imposition of fines and other penalties to be paid by members of the association;
15.1.8 the use of owners or their tenants of buildings and all other structures and upkeep, aesthetics and maintenance of such buildings; and
15.1.9 generally in regard to any other matter which the association, from time to time considers appropriate;
15.2 The purchaser undertakes and shall be obliged, with effect from the date of possession, to abide by such rules as if he was the owner of the property and to ensure that all tenants, nominees, invitees and other persons who occupy the property and/or go upon the estate by virtue of the purchaser's rights thereto, do likewise.
15.3 The purchaser further acknowledges that in the event of a conflict arising between a rule laid down by the association and a rule laid down by the body corporate, the purchaser will be bound by the rule of the association, which rule shall prevail and have precedence over the conflicting rule of the body corporate. 16 LETTING ARF T ARF T 1ST
Association Rules. Association may adopt from time to time (including during the Term) rules and regulations regarding the Licensee Services and/or Licensee’s activities within and outside the License Operation Area (the “Association Rules”). Licensee shall fully comply with all Association Rules.
