Assumption of Risk and Waiver of Liability. Parent specifically acknowledges that the “RP” activities will involve maneuvering a boat, sailboard or other watercraft on deep waters in potentially hazardous conditions which may include, among other things, strong winds and high waves, sudden and unexpected immersion in deep waters and collisions with other watercraft or stationary objects, such as docks, pilings, and buoys. With knowledge of the dangers involved, Xxxxxx hereby voluntarily requests that his/her Child be allowed to take part in the “RP” activities. PARENT XXXXXX ACCEPTS ANY AND ALL RISKS TO HIS/HER CHILD OF INJURY, DEATH AND PROPERTY DAMAGE ARISING FROM PARTICIPATION IN THE “RP” ACTIVITIES AND THE USE OF THE “RP” FACILITIES AND PROPERTY, WHETHER OR NOT CAUSED BY THE NEGLIGENCE OR GROSS NEGLIGENCE of “RP” and its directors, officers, employees, volunteers, members and/or members of “RP” members’ families. Parent does hereby release and forever discharge “RP” and its directors, officers, employees, volunteers, members and members of “RP” members’ families and their successors and assigns from any and all liability, claims and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from his/her Child’s participation in “RP” activities. Parent understands that this Release discharges “RP” from any liability or claim that the Parent or Child may have against “RP” with respect to any bodily injury, personal injury, illness, death or property damage that may result from his/her Child’s participation in “RP” activities, whether caused by the negligence or gross negligence of “RP”, its directors, officers, employees, volunteers, members and members of “RP” members’ families or other participants in “RP” activities or otherwise arising. Parent also understands that “RP” does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance in the event of injury or illness. With knowledge any volunteers (altogether referred to as “Camp Parties”), from and against all liability for loss or damage of property or money, any sickness, injury (minor or serious) or death that my child may incur, or any claim of any kind, however caused, resulting from or related in any way to my participation in any and all activities and events at Our Lady of the dangers involvedFields Camp and Retreat Center. INDEMNIFICATION I expressly agree to indemnify and hold harmless Our Lady of the Fields Camp and Retreat Center and all the Camp Parties from any liability to my child or any third party, Xxxxxx hereby resulting from or in any way relating to my child’s participation in any and all activities and events. I understand that the “RP” scope of my volunteer relationship with BEAR…BE A Resource for CPS Kids is limited to a volunteer position and that no compensation is expected in return for services provided by me; that BEAR…BE A Resource for CPS Kids will not provide any benefits traditionally associated with employment; and that I am responsible for my own insurance coverage in the event of illness or personal injury as a result of my services to BEAR…BE A Resource for CPS Kids. I understand that my volunteer activities will involve maneuvering a boatwith BEAR…BE A Resource for CPS Kids may include activities that could be hazardous to me, sailboard or other watercraft on deep waters in potentially hazardous conditions which may includeincluding but not limited to packing, among other thingsloading, strong winds unloading and high wavescarrying heavy items, sudden sorting items to be distributed to CPS Caseworkers, transportation to and unexpected immersion in deep waters and collisions with other watercraft or stationary objects, such as docks, pilingsfrom work sites, and buoysexposure to people with infectious diseases. With knowledge of I fully understand and appreciate the dangers involved, Xxxxxx hereby voluntarily requests risks that his/her Child be allowed are inherent to take part in the “RP” my volunteer activities. PARENT XXXXXX ACCEPTS ANY AND ALL RISKS TO HIS/HER CHILD OF INJURYI hereby assume the risk of bodily injury, DEATH AND PROPERTY DAMAGE ARISING FROM PARTICIPATION IN THE “RP” ACTIVITIES AND THE USE OF THE “RP” FACILITIES AND PROPERTYillness, WHETHER OR NOT CAUSED BY THE NEGLIGENCE OR GROSS NEGLIGENCE death, medical treatment and property damage resulting from my volunteer as of “RP” and 3/25/2020 activities, even if resulting from the negligence of BEAR…BE A Resource for CPS Kids or its officers, directors, officersemployees or agents. I hereby release, employeesdischarge and agree to indemnify and hold BEAR…BE A Resource for CPS Kids harmless from, volunteersand waive on behalf of myself and my heirs and personal representatives and any minors I am responsible for who volunteer with me, members and/or members of “RP” members’ families. Parent does hereby release and forever discharge “RP” and its directors, officers, employees, volunteers, members and members of “RP” members’ families and their successors and assigns from any and all liabilitycauses of action, claims claims, demands, damages, costs, expenses and demands compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of whatever kind BEAR…BE A Resource for CPS Kids, or naturethat may otherwise arise in any way in connection with any voluntary activities with, either in law or in equity, which arise or may hereafter arise from his/her Child’s participation in “RP” activitiesfor BEAR…BE A Resource for CPS Kids. Parent understands I understand that this Release release discharges “RP” BEAR…BE A Resource for CPS Kids from any liability or claim that the Parent I or Child my heirs, personal representatives or minors I am responsible for may have against “RP” BEAR…BE A Resource for CPS Kids with respect to any bodily injury, personal injury, illness, death death, medical treatment, or property damage that may result arise from his/her Child’s participation or in “RP” connection with my volunteer activities. This liability waiver and release extends to BEAR…BE A Resource for CPS Kids together with all of its officers, whether caused by the negligence or gross negligence of “RP”, its directors, officersaffiliates, employeesemployees and agents. I agree that this release will be governed by Texas law and that the exclusive venue for any dispute arising from this release will be a court of competent jurisdiction sitting in Houston, volunteers, members and members of “RP” members’ families or other participants in “RP” activities or otherwise arising. Parent also understands that “RP” does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance in the event of injury or illness.
