Common use of Assumption or Termination by Trustee Clause in Contracts

Assumption or Termination by Trustee. If the Master Servicer shall for any reason no longer be the Master Servicer, pursuant to the Pooling and Servicing Agreement (including, without limitation, by reason of an Event of Default and its termination thereunder), the successor Master Servicer (including the Trustee or its designee) shall assume the terminated Master Servicer's obligations or responsibilities under this Agreement, provided that the Primary Servicer is not in default under this Agreement, as a condition precedent to its becoming successor Master Servicer.
