Common use of Attachments; Judgments Clause in Contracts

Attachments; Judgments. Any portion of Borrower’s assets is attached or seized, or a levy is filed against any such assets, or a judgment or judgments is/are entered for the payment of money (not covered by independent third party insurance as to which liability has not been rejected by such insurance carrier), individually or in the aggregate, of at least Two Hundred Thousand Dollars ($200,000) and Borrower fails to satisfy and discharge the same within thirty (30) days; or

Attachments; Judgments. Any portion of Borrower’s assets is attached or seized, or a levy is filed against any such assets, or a judgment or judgments is/are entered for the payment of money (not covered by independent third party insurance as to which liability has not been rejected by such insurance carrier), individually or in the aggregate, of at least Two Hundred Thousand Dollars ($200,000) and 250,000, or Borrower fails to satisfy and discharge the same within thirty (30) daysis enjoined or in any way prevented by court order from conducting any part of its business; or

Any portion of Borrower’s assets is attached or seized, or a levy is filed against any such assets, or a judgment or judgments is/are entered for the payment of money (not covered by independent third party insurance as to which liability has not been rejected by such insurance carrier), individually or in the aggregate, of at least Two Hundred Thousand Dollars ($200,000) and 200,000.00), or Borrower fails to satisfy and discharge the same within thirty (30) daysis enjoined or in any way prevented by court order from conducting any part of its business; or

Any portion of Borrower’s assets is attached or seized, or a levy is filed against any such assets, or a judgment or judgments is/are entered for the payment of money (not covered by independent third party insurance as to which liability has not been rejected by such insurance carrier), individually or in the aggregate, of at least Two Hundred Thousand Dollars ($200,000) and 100,000, or Borrower fails to satisfy and discharge the same within thirty (30) daysis enjoined or in any way prevented by court order from conducting any part of its business; or

Any portion of Borrower’s assets is attached or seized, or a levy is filed against any such assets, or a judgment or judgments is/are entered for the payment of money (not covered by independent third party insurance as to which liability has not been rejected by such insurance carrier), individually or in the aggregate, of at least Two Hundred Thousand Dollars ($200,000) and 600,000, or Borrower fails to satisfy and discharge the same within thirty (30) daysis enjoined or in any way prevented by court order from conducting any part of its business; or

Any portion of Borrower’s assets is attached or seized, or a levy is filed against any such assets, or a judgment or judgments is/are entered for the payment of money (not covered by independent third party insurance as to which liability has not been rejected by such insurance carrier), individually or in the aggregate, of at least Two Hundred Thousand Dollars ($200,000) and 500,000, or Borrower fails to satisfy and discharge the same within thirty (30) daysis enjoined or in any way prevented by court order from developing or commercializing TRC101; or

Any portion of Borrower’s assets is attached or seized, or a levy is filed against any such assets, or a judgment or judgments is/are entered for the payment of money (not covered by independent third party insurance as to which liability has not been rejected by such insurance carrier), individually or in the aggregate, of at least Two One Hundred Thousand Dollars ($200,000) and 100,000), or Borrower fails to satisfy and discharge the same within thirty (30) daysis enjoined or in any way prevented by court order from conducting any part of its business; or

Attachments; Judgments. Any portion of Borrower’s assets is attached or seized, or a levy is filed against any such assets, or a judgment or judgments is/are entered for the payment of money (not covered by independent third party insurance as to which liability has not been rejected by such insurance carrier), individually or in the aggregate, of at least Two Hundred Thousand Dollars ($200,000) 2,000,000, or Borrower is enjoined or in any way prevented by court order from developing or commercializing TRC101, and Borrower fails to satisfy and discharge such court order has not been vacated or overturned within forty- five days of the same within thirty (30) dayseffectiveness thereof; oror 9.7

Attachments; Judgments. Any portion of Borrower’s assets is attached or seized, or a levy is filed against any such assets, or a final judgment or judgments is/are entered for the payment of money (not covered by independent third party insurance as to which liability has not been rejected by such insurance carrier), individually or in the aggregate, of at least Two Hundred Thousand Dollars ($200,000) and 750,000, or Borrower fails to satisfy and discharge the same within thirty (30) is enjoined or in any way prevented by court order from conducting any part of its business for a period of more than 30 consecutive days; or

Any portion of Borrower’s assets is attached or seized, or a levy is filed against any such assets, or a judgment or judgments is/are entered for the payment of money (not covered by independent third party insurance as to which liability has not been 26 rejected by such insurance carrier), individually or in the aggregate, of at least Two Hundred Thousand Dollars ($200,000) and 250,000, or Borrower fails to satisfy and discharge the same within thirty (30) daysis enjoined or in any way prevented by court order from conducting any part of its business; oror 9.7

Any portion of Borrower’s assets is attached or seized, or a levy is filed against any such assets, or a judgment or judgments is/are entered for the payment of money (not covered by independent third party insurance as to which liability has not been rejected by such insurance carrier), individually or in the aggregate, of at least Two One Hundred Thousand Dollars ($200,000100,000) and Borrower fails to satisfy and discharge the same within thirty (30) days; or
