Common use of Attachments; Judgments Clause in Contracts

Attachments; Judgments. Any portion of Borrower’s assets is attached or seized, or a levy is filed against any such assets (and such attachment, seizure or levy is not lifted or released within 30 days), or a judgment or judgments (no longer subject to appeal) is/are entered for the payment of money, individually or in the aggregate, of at least $250,000, or Borrower is enjoined or in any way prevented by court order from conducting any part of its business; or

Attachments; Judgments. Any portion of Borrower’s assets is attached or seized, or a levy is filed against any such assets (and such attachment, seizure or levy is not lifted or released within 30 days), or a judgment or judgments (no longer subject to appeal) (excluding the Extera Judgment) is/are entered for the payment of money, individually or in the aggregate, of at least $250,0002,000,000, unless otherwise waived by Lender in its reasonable discretion, or Borrower is enjoined or in any way prevented by court order from conducting any part of its business; or

Any portion of Borrower’s assets is attached or seized, or a levy is filed against any such assets (and such attachment, seizure or levy is not lifted or released within 30 days)assets, or a judgment or judgments (no longer subject to appeal) is/are entered for the payment of money, individually or in the aggregate, of at least $250,000, or Borrower is enjoined or in any way prevented by court order from conducting any part 250,000 and such judgment remains unstayed for a period of its businessfifteen (15) days; or

Any portion of Borrower’s assets is attached or seized, or a levy is filed against any such assets (and such attachment, seizure or levy is not lifted or released within 30 days)assets, or a final, nonappealable judgment or judgments (no longer subject to appeal) is/are entered for the payment of moneymoney and not otherwise covered by insurance and remains unpaid for more than 20 days, individually or in the aggregate, of at least $250,000500,000, or Borrower is enjoined or in any way prevented by court order from conducting any a part of its business; or

Any portion of Borrower’s assets having a value of $10,000 is attached or seized, or a levy is filed against any such assets (and such attachment, seizure or levy is not lifted or released within 30 days)assets, or a judgment or judgments (no longer subject to appeal) is/are entered for the payment of money, individually or in the aggregate, of at least $250,00025,000 and shall remain unsatisfied, unvacated or unstayed for a period of thirty (30) days after the entry thereof, or Borrower is enjoined or in any way prevented by court order from conducting any part of its business; or;
