AUCTIONEER’S COMMISSION. Assiter & Associates, LLC, a Texas limited liability company, served as the auctioneer and real estate broker (“Auctioneer”) and has conducted the auction to sell the Property. Seller shall pay Auctioneer, in Xxxxxxx County, Texas, a commission as set forth in a separate agreement. The Title Company is authorized to disburse Auctioneer’s fee from Seller’s funds.

AUCTIONEER’S COMMISSION. 13.1 The parties hereby agree that the AUCTIONEER is the effective cause of this transaction and that it is entitled to auctioneers’ commission at confirmation of this sale which shall be paid by the SELLER and/or PURCHASER. 13.2 The SELLER will be liable for auctioneers’ commission of 6% (exclusive of VAT). 13.3 Notwithstanding anything to the contrary the party responsible for non-compliance of this agreement will be responsible for immediate payment of the total auctioneers’ commission and expenses incurred.
AUCTIONEER’S COMMISSION. 18.1 The Purchaser shall be liable for and pay, in addition to the purchase price and transfer costs, Auctioneer’s commission of 5% (Five percent) of the Purchase Price, plus VAT, which commission shall be deemed to have been earned immediately upon the signing of acceptance of the Purchaser’s offer in terms hereof by the Seller or Auctioneer authorised by the Seller. 18.2 The Auctioneer pay the full amount of the Auctioneer’s commission into the trust account of the Auctioneer immediately on the fall of the hammer in the auction to which this agreement pertains. The commission amount shall be retained in the trust account of the Auctioneer for the benefit of the Purchaser pending the acceptance by the Seller or the Auctioneer if authorised by the Seller of the Purchaser’s offer or until the Seller either rejects the offer or until expiry of the confirmation period.
AUCTIONEER’S COMMISSION. 5.1. Besides the purchase price, the PURCHASER is liable for payment of the AUCTIONEER’s commission promulgated prior to the auction and set out in Schedule 1 hereto, plus VAT. 5.2. The commission will be deemed to have been earned and is payable immediately upon the signing of acceptance of the PURCHASER’S offer in terms hereof by the SELLER. 5.3. The PURCHASER shall pay the full amount of AUCTIONEER’s commission into the nominated trust account of the AUCTIONEER immediately on the fall of the hammer, but this amount shall remain the property of the PURCHASER and shall be retained in trust by the AUCTIONEER or the SELLER’s attorneys for the benefit of the PURCHASER pending acceptance by the SELLER of the PURCHASER’s offer or until the SELLER either rejects the offer or until expiry of the confirmation period as set out in clause 2.1. 5.4. Where the SELLER accepts the offer of the PURCHASER, the PURCHASER authorizes the AUCTIONEER and/or the SELLER’s attorney to immediately pay over the commission earned plus VAT, to the AUCTIONEER from the trust account. 5.5. Should the SELLER or PURCHASER fail to meet their commitments under this agreement, the AUCTIONEER shall be entitled to recover such commission from the party responsible for breach of contract. It is hereby recorded that should this sale be cancelled by mutual agreement, the AUCTIONEER shall be entitled to the commission under this agreement which shall be jointly and severally payable by the SELLER and the PURCHASER. 5.6. The provisions of the clause 5 are inserted and intended for the benefit of the AUCTIONEER who by his signature hereto, accepts such benefit.
AUCTIONEER’S COMMISSION. 6.1.1. The PURCHASER, by signature hereof gives permission that the commission and the marketing costs of the AUCTIONEER may be deducted from the deposit as contemplated in clause 5.3.1 payable by the PURCHASER, which deductions may be reconciled and paid on date of acceptance.

AUCTIONEER’S COMMISSION. 3.1 Commission calculated at 7.5% of the purchase price plus VAT (if applicable), in the amount of R ________ _______ __ __ ______ ___ __ _ will be due and payable by the PURCHASER to the AUCTIONEER immediately upon the acceptance by the SELLER. It is further recorded that no bridging of AUCTIONEER’S commission and/or any part thereof shall be permitted. 3.2 If the commission is not paid by the PURCHASER to the AUCTIONEER in terms hereof for any reason whatsoever, the SELLER hereby instructs his attorneys to pay the commission or balance thereof, whichever may be applicable, to the AUCTIONEER as a first draw from the proceeds of this sale, against registration of transfer of the property into the name of the PURCHASER. The AUCTIONEER warrants that he did not contravene Sections 29, 40, or 41 of the Consumer Protection Act, Act 68 of 2008 and indemnifies the SELLER in this respect against any claim(s) by the PURCHASER.

AUCTIONEER’S COMMISSION. (i) The Auctioneer will be entitled to charge the Seller commission as a percentage of the Hammer Price for any Lot at the rate specified on the entry form for his services (“Commission”) together with such entry fees expenses and other charges both due under these Conditions and as may also have been agreed with the Seller (“Charges”). The Commission and Charges shall be subject to VAT at the appropriate rate or rates. In this instance the Seller commission will be 10% + VAT on the first £1,000, 5% + VAT on £1,001+ per lot. (ii) Any Lot included on the Entry Form by the Seller which is purchased by the Seller or on his behalf will be subject to charges and commission in accordance with these Conditions.

If commission is not paid by the SELLER to the AUCTIONEER in terms hereof for any reason whatsoever, the SELLER hereby instructs his attorneys to pay the commission or balance thereof, whichever may be applicable, to the AUCTIONEER as a first draw from the proceeds of this sale, against registration of transfer of the PROPERTY into the name of the PURCHASER. 5.3. The SELLER shall be liable to pay to the AUCTIONEER, upon demand, a fee equal to any bank charges that the AUCTIONEER may become liable for upon payment of the AUCTIONEER’s commission into the AUCTIONEER’s chosen bank account. 5.4. The provisions of this clause 5 are inserted and intended for the benefit of the AUCTIONEER who by his signature hereto, accepts such benefit.
