Common use of Authority Property Clause in Contracts

Authority Property. 29.1 Where the Authority for the purpose of the Agreement issues Authority Property free of charge to the Supplier such property shall be and remain the property of the Authority. The Supplier shall not in any circumstances have a lien on the Authority Property and the Supplier shall take all reasonable steps to ensure that the title of the Authority to such Authority Property and the exclusion of any such lien are brought to the notice of all Sub-Contractors and other persons dealing with the Agreement. 29.2 Any Authority Property made available or otherwise received by the Supplier shall be deemed to be in good condition when received by or on behalf of the Supplier unless the Supplier notifies the Authority otherwise within 5 Working Days of receipt. 29.3 The Supplier shall maintain all Authority Property in good order and condition, excluding fair wear and tear, and shall use Authority Property solely in connection with the Agreement and for no other purpose without prior Approval. 29.4 The Supplier shall ensure the security of all Authority Property, whilst in the Supplier’s possession, either on its premises or elsewhere during the performance of the Agreement, in accordance with the Authority’s reasonable security requirements as required from time to time. 29.5 The Supplier shall be liable for any and all Loss of or damage (excluding fair wear and tear) to any Authority Property, unless the Supplier is able to demonstrate that such loss or damage was caused by the negligence or default of the Authority. The Supplier’s liability set out in this clause shall be reduced to the extent that such Loss or damage was contributed to by the negligence or default of the Authority. The Supplier shall inform the Authorised Officer within 2 Working Days of becoming aware of any defects appearing in or losses or damage occurring to Authority Property made available for the purposes of the Agreement.

The Supplier Contractor shall not in any circumstances have a lien on the Authority Property and the Supplier Contractor shall take all reasonable steps to ensure that the title of the Authority to such Authority Property and the exclusion of any such lien are brought to the notice of all Subsub-Contractors contractors and other persons dealing with the Agreement. 29.2 Any 18.2 Subject to clause 11.A.1 any Authority Property made available or otherwise received by the Supplier Contractor shall be deemed to be in good condition when received by or on behalf of the Supplier Contractor unless the Supplier Contractor notifies the Authority otherwise within 5 Working Days of receipt. 29.3 The Supplier 18.3 Subject to Clause 11.A.1 the Contractor shall maintain all Authority Property in good order and condition, excluding fair wear and tear, and shall use Authority Property solely in connection with the Agreement and for no other purpose without prior Approval. 29.4 18.4 The Supplier Contractor shall ensure the security of all Authority Property, whilst in the SupplierContractor’s possession, either on its premises or elsewhere during the performance of the Agreement, in accordance with the Authority’s reasonable security requirements as required notified from time to time. 29.5 18.5 The Supplier Contractor shall be liable for any and all Loss loss of or damage (excluding fair wear and tear) to any Authority Property, unless the Supplier Contractor is able to demonstrate that such loss or damage was caused by the negligence or default of the Authority. The SupplierContractor’s liability set out in this clause shall be reduced to the extent that such Loss loss or damage was contributed to by the negligence or default of the Authority. The Supplier Contractor shall inform the Authorised Officer Contract Manager within 2 Working Days of becoming aware of any material defects appearing in or losses or damage occurring to Authority Property made available for the purposes of the Agreement.

Authority and the Supplier irrevocably licences the Authority and its agents to enter upon any premises of the Supplier during normal business hours on reasonable notice to recover any such Authority Property. 31.2 The Supplier shall not in any circumstances have a lien or any other interest on the Authority Property and at all times the Supplier shall possess the Authority Property as fiduciary agent and bailee of the Authority. 31.3 The Supplier shall take all reasonable steps to ensure that the title of the Authority to such the Authority Property and the exclusion of any such lien or other interest are brought to the notice of all Sub-Contractors and other appropriate persons dealing with and shall, at the AgreementAuthority's request, store the Authority Property separately and securely and ensure that it is clearly identifiable as belonging to the Authority. 29.2 Any 31.4 The Authority Property made available or otherwise received by the Supplier shall be deemed to be in good condition when received by or on behalf of the Supplier unless the Supplier notifies the Authority otherwise within 5 five (5) Working Days of receipt. 29.3 31.5 The Supplier shall maintain all the Authority Property in good order and condition, condition (excluding fair wear and tear, ) and shall use the Authority Property solely in connection with the Agreement this Contract and for no other purpose without prior Approval. 29.4 31.6 The Supplier shall ensure the security of all the Authority Property, Property whilst in the Supplier’s its possession, either on its premises the Sites or elsewhere during the performance supply of the AgreementServices, in accordance with the Authority's Security Policy and the Authority’s reasonable security requirements as required from time to time. 29.5 31.7 The Supplier shall be liable for any and all Loss of loss of, or damage to the Authority Property, (excluding fair wear and tear) to any Authority Property), unless the Supplier is able to demonstrate that such loss or damage was solely caused by the negligence or default of the Authority. The Supplier’s liability set out in this clause shall be reduced to the extent that such Loss or damage was contributed to by the negligence or default of the Authoritya Authority Cause. The Supplier shall inform the Authorised Officer within 2 Working Days Authority immediately of becoming aware of any defects appearing in or losses or damage occurring to the Authority Property made available for the purposes of the AgreementProperty.

The Supplier’s liability set out in this clause shall be reduced to the extent that such Loss or damage was contributed to by the negligence or default of the Authorityan Authority Cause. The Supplier shall inform the Authorised Officer within 2 Working Days Authority immediately of becoming aware of any defects appearing in or losses or damage occurring to the Authority Property made available for the purposes of the AgreementProperty.

The Supplier Contractor shall inform the Authorised Officer Contract Manager within 2 Working Days of becoming aware of any defects appearing in or losses or damage occurring to Authority Property made available for the purposes of the Agreement. 19 Sub-Contracting for the delivery of the Services 19.1 Where the Contractor enters into a sub-contract with a supplier or contractor for the purpose of performing the Agreement, it shall cause a term to be included in such a sub-contract which requires payment to be made of undisputed sums by the Contractor to the sub-contractor within a specified period not exceeding 30 days from the receipt of a valid invoice, as defined by the sub-contract requirements.
