Common use of Authorization of Series E Preferred Shares Clause in Contracts

Authorization of Series E Preferred Shares. As of the Closing, the Company shall have authorized the issuance, pursuant to the terms and subject to the conditions of this Agreement of 4,545,455 Series E Preferred Shares, each having the rights, preferences, privileges and restrictions as set forth in the Amended Articles and the Amended XXX.
