Authorized Version Clause Samples

Authorized Version. Section 1.8 of the iNDemand Agreement is hereby replaced in its entirety with the following:

Authorized Version. The following is added at the end of Section 1.22 of the Original Agreement: “For the avoidance of doubt, the term “Included Program” shall include only the version of the applicable Current Film, Library Film or TV Series made available by Licensor to Licensee for distribution on a Video-On-Demand basis or Pay-Per-View basis, as applicable, hereunder (which shall in no event include any 3D version unless otherwise mutually agreed).” [Note: This term is meant to speak more to the content of a program, not its resolution or technical format. And, as discussed further below in Section 11, ▇▇▇▇ should not be modifying the substance of programs or upconverting in any event.]
