Automatic Deemed Amendment Sample Clauses

Automatic Deemed Amendment. Notwithstanding anything herein to the contrary, effective upon each issuance of any Rights hereunder, each of the following shall apply: (A) the defined term “Warrants” as used herein and in the other Transaction Documents shall be deemed to be automatically amended to include such Rights and (B) the defined term “Warrant Shares” shall be deemed automatically amended to include such Reserved Shares issuable upon exercise of such Rights.
