Common use of AVAILABILITY AND SUBSTITUTION OF FUNDS Clause in Contracts

AVAILABILITY AND SUBSTITUTION OF FUNDS. a. Notwithstanding any provision herein, this Contract is valid and enforceable only if sufficient funds are available. In the event of reduction, suspension, discontinuance, or other unavailability of funds, COUNTY unilaterally may take appropriate actions including, but not limited to, reducing existing service authorization, immediate termination of the Contract, or reducing the maximum dollar amount of this Contract with no liability occurring to the COUNTY.
