Common use of Availability of Ancillary Services Clause in Contracts

Availability of Ancillary Services. Buyer shall be entitled, at ---------------------------------- no additional cost, to all Ancillary Services with respect to the Net Dependable Capacity at the Point of Delivery. Seller does not guarantee the availability of any ancillary services but does warrant that it will not remarket such services to any third party; except in the case of Buyer default under Section 13.2.1. Notwithstanding the above, Seller has the right to use Ancillary Services to meet any requirement of the Interconnected Utility System, the ISO, or their successors.
