Availability of Earnings Statement. As soon as practicable, but in any event not later than 16 months after the effective date of the Registration Statement, and otherwise at the times specified in Rule 158 under the Securities Act, the Company will make generally available to its security holders an earnings statement that will satisfy the provisions of Section 11(a) of the Securities Act (including, at the option of the Company, Rule 158 under the Securities Act).
