Availability of Earnings Statements. The Partnership shall make generally available to its unitholders and to BMOCM an earnings statement or statements of the Partnership and its subsidiaries which will satisfy, on a timely basis, the provisions of Section 11(a) of the Act and Rule 158 under the Act.
