Common use of Availability Reports Clause in Contracts

Availability Reports. In the event that the Project is unable to meet the Contract Capacity requirements as set forth in this Agreement (a "Change in Availability"), Seller shall (i) use commercially reasonable efforts to notify Buyer of any Change in Availability within ten (10) minutes of the occurrence of such outage, and (ii) provide a written estimate of its expected duration and the causes of such Change in Availability within one (1) hour thereafter. Seller shall also notify Buyer in writing upon the return of the Project to normal operation so as to meet the Contract Capacity requirements set forth in this Agreement.
