Avoidance of Noise and Disturbance. All Work at the Site (including night, weekend or Holiday Work subject to the requirements of Section 9.4 (“Night, Weekend or Holiday Work”)) shall be carried out in such a way as to minimize noise and disturbance and Seller shall indemnify and keep indemnified Buyer against any costs, losses or expenses, including without limitation, liability for damages arising out of or in connection with noise or other disturbance, falling outside of the limits specified in the Applicable Law and created by Seller in performing the Work.
