No group of citizens or neighborhood will be subject to disproportionate environmental impacts. Citizens in communities surrounding Labs21 partners are expected to benefit from the implementation of projects undertaken as part of meeting the Labs21 commitments. Any possibility of risk shifts due to flexibility granted through XL will be scrutinized and minimized or eliminated as part of the XL review process.

Avoidance of Shifting the. Risk Burden to Other Areas or Media As stated above, there will be no transfer of pollution from one media to another in this project but rather a prevention of degradation by reducing or eliminating the contact of water with the acid forming rock overburden or by taking measures to produce alkaline waters. Information is available on the percentage of minority and low income populations in the areas around the proposed mining sites. The areas generally have a low population and little if any minority population. Both counties where the sites are located have a higher percentage of below poverty population than the state or Region III average

No group of citizens or neighborhood will be subject to disproportionate environmental impacts. Citizens in the Denver area will benefit from better air quality resulting from the replacement of 512 high-emission vehicles and 282 LLVs (1987-1991 vintage USPS delivery vehicles) with approximately 810 FFVs. Citizens in other western cities will benefit by the replacement of 282 high-emission vehicles (most of which will then be scrapped) with the 282 LLVs relocated from the Denver area. Because the LLVs will replace higher emission vehicles, citizens of these other cities will experience no detrimental impacts. In addition, the safety technology incorporated into all new vehicles benefits those drivers who will be operating the new FFVs. The USPS is replacing vehicles that are approximately twenty years old. Advances in safety technologies of vehicles in the past two decades are an inherent benefit to the vehicle operator. In this way the project will reduce risks to vehicle operators significantly.

  • Joint Responsibility If the Seller determines that the Interface Problem is attributable partially to the design of a Warranted Part and partially to the design of any Supplier Part, the Seller will, if so requested by the Buyer, seek a solution to the Interface Problem through cooperative efforts of the Seller and any Supplier involved. The Seller will promptly advise the Buyer of such corrective action as may be proposed by the Seller and any such Supplier. Such proposal will be consistent with any then existing obligations of the Seller hereunder and of any such Supplier towards the Buyer. Such corrective action, unless reasonably rejected by the Buyer, will constitute full satisfaction of any claim the Buyer may have against either the Seller or any such Supplier with respect to such Interface Problem.

  • Payment Responsibility The payment obligations of each Participating Manufacturer pursuant to this Agreement shall be the several responsibility only of that Participating Manufacturer. The payment obligations of a Participating Manufacturer shall not be the obligation or responsibility of any Affiliate of such Participating Manufacturer. The payment obligations of a Participating Manufacturer shall not be the obligation or responsibility of any other Participating Manufacturer. Provided, however, that no provision of this Agreement shall waive or excuse liability under any state or federal fraudulent conveyance or fraudulent transfer law. Any Participating Manufacturer whose Market Share (or Relative Market Share) in any given year equals zero shall have no payment obligations under this Agreement in the succeeding year.

  • Waiver of responsibility 1. Any appraisal of the Programme undertaken before or after its approval by the FMC, does not in any way diminish the responsibility of the National Focal Point and the Programme Operator to verify and confirm the correctness of the documents and information forming the basis of the programme agreement.

  • Delegation of Responsibility Transmission Provider may use the services of subcontractors as it deems appropriate to perform its obligations under this LGIP. Transmission Provider shall remain primarily liable to Interconnection Customer for the performance of such subcontractors and compliance with its obligations of this LGIP.   • Agreements Relating to Sentencing 10. The government agrees to recommend that the Court impose a sentence of imprisonment within the applicable guidelines range and to make no further recommendation concerning what sentence of imprisonment should be imposed.

  • Transfer of Responsibility on Expiry or Termination 15.1 The Contractor shall, at no cost to the Department, promptly provide such assistance and comply with such timetable as the Department may reasonably require for the purpose of ensuring an orderly transfer of responsibility upon the expiry or other termination of this Contract. The Department shall be entitled to require the provision of such assistance both prior to and, for a reasonable period of time after the expiry or other termination of this Contract.
