Back Royalties. Any royalties pursuant to the above schedule which accrued under the terms of this Agreement during the period from the time in which royalties are payable under this Agreement to the latest signature date of this Agreement shall be payable within one calendar month of such signature date together with accrued interest of ten percent (10%) per annum from the date of Sale of the AVC Royalty Product to which the royalty applies, and shall be accompanied by a royalty statement in accordance with Section 3.11 of this Agreement.
Back Royalties. 3.7.1 Back royalty shall be due for any unauthorised use of the Licensed Patents after January 1st 2001.
3.7.2 Any back royalties exempted on the basis of the section 3.7.1 of this Agreement will be due in the case of a termination by the Licensee or for material breach by licensee of this Agreement before December 31, 2006, together with accrued interest of 10% per annum pro rata ternporis on a monthly basis, and shall be paid within ninety (90) days after the written notice of such termination to Licensors as mentioned in the section 8.3.1 of this Agreement.
3.7.3 The back royalties shall be paid within 4 weeks after the Effective Date.
Back Royalties. Based on Licensee’s representation and warranty to Licensors that Licensee and its Affiliates Sales or other provision of Licensed Products prior to the Release Date was substantially as set forth on Exhibit C (excepting refurbished products and certain end devices agreed upon by the parties) attached hereto (“Past Sales”), Licensee has agreed to the royalty rate and the Initial Payment, Minimum Payments and Closing Payment set forth in Section 3.1 for Licensed Products as compensation intended to also cover any Past Sales. This term does not extend beyond the term of every Licensed Patent in Exhibit A. Licensee shall have no additional obligation to pay royalties for Past Sales other than by satisfaction of the payment terms set forth in Section 3.1.
Back Royalties. Any royalties pursuant to the above schedule on Open RAN Royalty Products Sold under the terms of this Agreement during the period between January 1, 2022 (hereinafter “Royalty Date”) and the latest Signature Date of this Agreement (hereinafter “Back Royalties”) shall be payable within one calendar month of such Signature Date together with accrued interest of ten percent (10%) per annum from the later of (1) the date of Sale of the Open RAN Royalty Product to which the royalty applies or (2) the date an Open RAN Patent Portfolio License was first offered to the market, and shall be accompanied by a royalty statement in accordance with Section 3.9.
Back Royalties. Except as provided in Paragraph 3.5.3, any royalties pursuant to the above schedule which accrued during the period from [***] to the latest signature date of this Agreement shall be payable within [***] of such signature date or end of accrual period, together with accrued interest of [***] per annum from the date of Sale of the MPEG-4 Visual Royalty Product to which the royalty applies, and shall be accompanied by a royalty statement in accordance with Section 3.11 of this Agreement.
Back Royalties. Any royalties pursuant to the above schedule which accrued during the period from June 1, 1994 to the latest signature date specified above shall be payable within thirty (30) Days of such signature date, together with accrued interest of 10% per annum.
