Common use of Back-up Clause in Contracts

Back-up. Supplier shall create and regularly test back-up copies of information and software and store them in a physically secure remote location, at a sufficient distance to make them reasonably immune from damage to data at the primary site. A formal definition of the level of back-up required for each system shall be defined and documented including the scope of data being imaged, frequency of imaging, and duration of retention. This document shall be based on the contractual, legal, regulatory, and business requirements.
