Background Patents and Patents Claiming Inventions. RMS shall have the right, but no obligation, to control, enforce, and defend worldwide, at its own expense, the Patents in RMS Background IP and any Patents claiming RMS Project Invention. Epizyme and Eisai shall have the right, but no obligation, to control, enforce, and defend worldwide, at its own expense, the Patents in Pharmaceutical Partners Background IP and any Patents claiming Pharmaceutical Partners Project Invention.
