Bankruptcy or Similar Proceedings. The commencement of any proceedings in bankruptcy by or against any Obligor or for the liquidation or reorganization of any Obligor, or alleging that such Obligor is insolvent or unable to pay its debts as they mature, or for the readjustment or arrangement of any Obligor’s debts, whether under the United States Bankruptcy Code or under any other law, whether state or federal, now or hereafter existing, for the relief of debtors, or the commencement of any analogous statutory or non-statutory proceedings involving any Obligor; provided, however, that if such commencement of proceedings against such Obligor is involuntary, such action shall not constitute an Event of Default unless such proceedings are not dismissed within sixty (60) days after the commencement of such proceedings, though Agent and Lenders shall have no obligation to make Revolving Loans to or issue, or cause to be issued, Letters of Credit on behalf of Borrower during such sixty (60) day period or, if earlier, until such proceedings are dismissed.

The commencement of any proceedings in bankruptcy by or against any Loan Party or for the liquidation or reorganization of any Loan Party, or alleging that such Loan Party is insolvent or unable to pay its debts as they mature, or for the readjustment or arrangement of any Loan Party ‘s debts, whether under the United States Bankruptcy Code or under any other law, whether state or federal, now or hereafter existing, for the relief of debtors, or the commencement of any analogous statutory or non- statutory proceedings involving any Loan Party; provided, however, that if such commencement of proceedings against such Loan Party is involuntary, such action shall not constitute an Event of Default unless such proceedings are not dismissed within 45 days after the commencement of such proceedings, though Administrative Agent and Lenders shall have no obligation to make Loans to or issue, or cause to be issued, Letters of Credit on behalf of Borrower during such 45 day period or, if earlier, until such proceedings are dismissed.
Bankruptcy or Similar Proceedings. Upon the occurrence of an Insolvency Event affecting any Obligor or any Subsidiary of Borrower;

The commencement of any proceedings in bankruptcy by or against any Obligor or for the liquidation or reorganization of any Obligor or any of Borrower’s other Subsidiaries, or alleging that such Obligor or Subsidiary of Borrower is insolvent or unable to pay its debts as they mature, or for the readjustment or arrangement of any Obligor’s or any of Borrower’s Subsidiaries’ debts, whether under the United States Bankruptcy Code or under any other law, whether state or federal, now or hereafter existing, for the relief of debtors, or the commencement of any analogous statutory or non-statutory proceedings involving any Obligor or any of Borrower’s other Subsidiaries; provided, however, that if such commencement of proceedings against such Obligor or such Subsidiary of Borrower is involuntary, such action shall not constitute an Event of Default unless such proceedings are not dismissed within thirty (30) days after the commencement of such proceedings.
Bankruptcy or Similar Proceedings. The commencement of any proceedings in bankruptcy by or against any Loan Party or for the liquidation or reorganization of any Loan Party, or alleging that such Loan Party is insolvent or unable to pay its debts as they mature, or for the readjustment or arrangement of any Loan Party’s debts, whether under the United States Bankruptcy Code or under any other law, whether state or federal, now or hereafter existing, for the relief of debtors, or the commencement of any analogous statutory or non-statutory proceedings involving any Loan Party, which, in the case of any such involuntary proceeding not stayed or dismissed within sixty (60) days after the filing thereof or is granted; or

The commencement of any proceedings in bankruptcy by or against any Borrower or for the liquidation or reorganization of any Borrower, or alleging that such Borrower is insolvent or unable to pay its debts as they mature, or for the readjustment or arrangement of any Borrower’s debts, whether under the United States Bankruptcy Code or the Canadian Bankruptcy Law, as applicable, or under any other law, whether state, provincial or federal, now or hereafter existing, for the relief of debtors, or the commencement of any analogous statutory or non-statutory proceedings involving any Borrower; provided, however, that if such commencement of proceedings against such Borrower is involuntary, such action shall not constitute an Event of Default unless such proceedings are not dismissed within sixty (60) days after the commencement of such proceedings, though Administrative Agent and Lenders shall have no obligation to make Loans to or issue, or cause to be issued, Letters of Credit on behalf of any Borrower during such sixty (60) day period or, if earlier, until such proceedings are dismissed.

The commencement of any proceedings in bankruptcy by or against any Loan Party or any Subsidiary or for the liquidation or reorganization of any Loan Party or any Subsidiary, or alleging that such Loan Party or such Subsidiary is insolvent or unable to pay its debts as they mature, or for the readjustment or arrangement of any Loan Party’s or Subsidiary’s debts, whether under the United States Bankruptcy Code or under any other law, whether state or federal, now or hereafter existing, for the relief of debtors, or the commencement of any analogous statutory or non-statutory proceedings involving any Loan Party or any Subsidiary; provided, however, that if such commencement of proceedings, liquidation or reorganization, allegation, readjustment or arrangement against such Loan Party or Subsidiary is involuntary, such action shall not constitute an Event of Default unless such proceedings, liquidation or reorganization, allegation, readjustment or arrangement are not dismissed within sixty (60) days after the commencement of such proceedings, liquidation or reorganization, allegation, readjustment or arrangement, though Lender shall have no obligation to make Loans to or issue, or cause to be issued, Letters of Credit on behalf of any Borrower during such sixty (60) day period or, if earlier, until such proceedings, liquidation or reorganization, allegation, readjustment or arrangement are dismissed.
Bankruptcy or Similar Proceedings. The commencement of any proceedings in bankruptcy by or against Borrower or for the liquidation or reorganization of Borrower, or alleging that Borrower is insolvent or unable to pay its debts as they mature, or for the readjustment or arrangement of Borrower’s debts, whether under the United States Bankruptcy Code or under any other law, whether state or federal, now or hereafter existing, for the relief of debtors, or the commencement of any analogous statutory or non-statutory proceedings involving Borrower; provided, however, that if such commencement of proceedings against a Borrower is involuntary, such action shall not constitute an Event of Default unless such proceedings are not dismissed within forty-five (45) days after the commencement of such proceedings.
Bankruptcy or Similar Proceedings. Notwithstanding any other provision of this Agreement, for so long as any debt of the Trust remains outstanding, no action may be taken by the Trust (whether by the Board of Managers, or otherwise) in connection with any of the following matters:
(i) any Bankruptcy Action;
(ii) the merger of the Trust with any other entity;
(iii) the sale of all or substantially all of the Trust’s assets (other than by foreclosure on any Trust Property pledged for any authorized borrowing by the Trust); or the amendment of this Agreement; or
(iv) the termination, revocation, dissolution or liquidation, in whole or in part, of the Trust.
