Common use of Base Year; Tenant’s Pro Rata Share Clause in Contracts

Base Year; Tenant’s Pro Rata Share. Notwithstanding any provision of the Existing Lease to the contrary, with respect to Expansion Space B, Tenant’s Building Share is conclusively agreed to be a total of 45.56%, Tenant’s Phase Share is conclusively agreed to be a total of 8.64% and Tenant’s Project Share is conclusively agreed to be a total of 4.85%.

Notwithstanding any provision of the Existing Lease to the contrary, with respect to Expansion Space BA, Tenant’s Building Share is conclusively agreed to be a total of 45.5675.46%, Tenant’s Phase Share is conclusively agreed to be a total of 8.6410.38% and Tenant’s Project Share is conclusively agreed to be a total of 4.854.55%.

Notwithstanding any provision of the Existing Lease to the contrary, with respect to Expansion Space BD, Tenant’s Building Share is conclusively agreed to be a total of 45.568.82%, Tenant’s Phase Share is conclusively agreed to be a total of 8.643.08% and Tenant’s Project Share is conclusively agreed to be a total of 4.851.35%.

Notwithstanding any provision of the Existing Lease to the contrary, with respect to Expansion Space BC, Tenant’s Building Share is conclusively agreed to be a total of 45.569.44%, Tenant’s Phase Share is conclusively agreed to be a total of 8.643.30% and Tenant’s Project Share is conclusively agreed to be a total of 4.851.45%.
