Common use of Base Year; Tenant’s Pro Rata Share Clause in Contracts

Base Year; Tenant’s Pro Rata Share. Notwithstanding any provision of the Existing Lease to the contrary, with respect to Expansion Space C, Tenant’s Building Share is conclusively agreed to be a total of 9.44%, Tenant’s Phase Share is conclusively agreed to be a total of 3.30% and Tenant’s Project Share is conclusively agreed to be a total of 1.45%.

Notwithstanding any provision of the Existing Lease to the contrary, with respect to Expansion Space CD, Tenant’s Building Share is conclusively agreed to be a total of 9.448.82%, Tenant’s Phase Share is conclusively agreed to be a total of 3.303.08% and Tenant’s Project Share is conclusively agreed to be a total of 1.451.35%.

Notwithstanding any provision of the Existing Lease to the contrary, with respect to Expansion Space CA, Tenant’s Building Share is conclusively agreed to be a total of 9.4475.46%, Tenant’s Phase Share is conclusively agreed to be a total of 3.3010.38% and Tenant’s Project Share is conclusively agreed to be a total of 1.454.55%.

Notwithstanding any provision of the Existing Lease to the contrary, with respect to Expansion Space CB, Tenant’s Building Share is conclusively agreed to be a total of 9.4445.56%, Tenant’s Phase Share is conclusively agreed to be a total of 3.308.64% and Tenant’s Project Share is conclusively agreed to be a total of 1.454.85%.
