Common use of Basis of Commission Clause in Contracts

Basis of Commission. The Commission shall apply to all orders solicited by Rep from the Territory that have been accepted by Company and for which shipment has occurred. No commissions shall be paid on (i) orders from outside the Territory (even if Rep receives the initial inquiry from outside the Territory) unless otherwise agreed in writing by Company. Commissions shall be computed on the net amount paid by customer.

Basis of Commission. The Commission shall apply to all orders to the Territory, whether or not such orders were solicited by Rep from the Territory that have been accepted by Company and for which shipment has occurred. No commissions shall be paid on (i) orders from outside the Territory (even if Rep receives the initial inquiry from outside the Territory) unless otherwise agreed in writing by CompanyRepresentative. Commissions shall be computed on the net sales amount invoiced by Company to the customer, provided no commission shall be paid by customerwith respect to charges for handling, freight, taxes, C.O.D. charges, insurance, tariffs and duties, cash and trade discounts, rebates, amounts allowed or credited for returns, uncollected or uncollectible amounts, services, and the like.

Basis of Commission. The Commission shall apply to all orders solicited by Rep from the Territory that have has been accepted assigned by Company, for which Company has approved a Product sale, and for which shipment Company has occurredbeen paid. No commissions shall be paid on (i) orders from outside solicited by Company within the Territory (even if or by another Sales Rep receives the initial inquiry from outside the within that same Territory) unless otherwise agreed in writing by Company. Commissions shall be computed on the net amount paid by customerat five percent (5%) of final sales price before taxes or fees unless otherwise agreed in writing.
