Common use of Basis of Commission Clause in Contracts

Basis of Commission. The Commission shall apply to all orders to the Territory, whether or not such orders were solicited by Representative. Commissions shall be computed on the net sales amount invoiced by Company to the customer, provided no commission shall be paid with respect to charges for handling, freight, taxes, C.O.D. charges, insurance, tariffs and duties, cash and trade discounts, rebates, amounts allowed or credited for returns, uncollected or uncollectible amounts, services, and the like.

Commissions shall be computed on the net collected gross sales amount invoiced by Company to from the customer, provided no commission shall be paid with respect to charges for handling, freight, taxes, C.O.D. charges, insurance, tariffs and duties, cash and trade discounts, rebates, amounts allowed or credited for returns, uncollected or uncollectible amounts, services, and the like.

Basis of Commission. The Commission shall apply to all orders to solicited by Agent from the Territory that have been accepted by Company and for which shipment has occurred. No commissions shall be paid on orders received from outside the Territory (even if Agent receives the initial inquiry from outside the Territory, whether or not such orders were solicited ) unless otherwise agreed in writing by RepresentativeCompany. Commissions shall be computed on the net sales amount invoiced billed by Company to the customer, provided and no commission shall be paid with respect to charges for handling, freight, sales taxes, C.O.D. charges, insurance, tariffs and import duties, cash and trade discounts, rebates, amounts allowed or credited for returns, uncollected or uncollectible amountsrepairs, services, and the like.
