BCBSRI Reporting Obligations for a Privacy Breach or Security Incident. (a) Privacy Breach. BCBSRI will report to Employer within ten (10) business days following discovery of any “Breach” of “Unsecured Protected Health Information” as these terms are defined by the HITECH Act and its implementing regulations. Any such report shall include the identification (if known) of each individual whose Unsecured Protected Health Information has been, or is reasonably believed by BCBSRI to have been, accessed, acquired, or Disclosed during such Breach. BCBSRI shall cooperate with Employer in investigating the Breach and in meeting the Plan’s obligations under the HITECH Act and any other security breach notification laws.
