Common use of Benefits of this Agreement Clause in Contracts

Benefits of this Agreement. Nothing in this Agreement shall be construed to give to any Person other than the Company, the Rights Agent and the registered holders of the Rights Certificates (and, prior to the Distribution Date, the registered holders of the stock certificates for the Common Stock of the Company) any legal or equitable right, remedy or claim under this Agreement; but this Agreement shall be for the sole and exclusive benefit of the Company, the Rights Agent and the registered holders of the Rights Certificates (and, prior to the Distribution Date, the registered holders of the stock certificates for the Common Stock of the Company).

Benefits of this Agreement. Nothing in this Agreement shall be construed to give to any Person other than the Company, the Rights Agent and the registered holders of the Rights Certificates (and, prior to the Distribution Date, the registered holders of the stock certificates for the Common Stock of the CompanyStock) any legal or equitable right, remedy or claim under this Agreement; but this Agreement shall be for the sole and exclusive benefit of the Company, the Rights Agent and the registered holders of the Rights Certificates (and, prior to the Distribution Date, the registered holders of Common Stock). Prior to the stock certificates for Distribution Date, the Common Stock interests of the Company)holders of Rights shall be deemed coincident with the interests of the holders of shares of Common Stock.

Nothing in this Agreement shall be construed to give to any Person other than the Company, the Rights Agent and the registered holders of the Rights Certificates (and, prior to the Distribution Date, the registered holders of the stock certificates for the Common Stock of the CompanyStock) any legal or equitable right, remedy or claim under this Agreement; but this Agreement shall be for the sole and exclusive benefit of the Company, the Rights Agent and the registered holders of the Rights Certificates (and, prior to the Distribution Date, the registered holders of Common Stock). Prior to the stock certificates for Distribution Date, the Common Stock interests of the Company)holders of Rights shall be deemed coincident with the interests of the holders of shares of Common Stock.

Benefits of this Agreement. Nothing in this Agreement shall be construed to give to any Person other than the Company, the Rights Agent and the registered holders of the Rights Certificates (and, prior to the Distribution Date, the registered holders of the stock certificates for the Common Stock of the Company, and the Series C Preferred Stock) any legal or equitable right, remedy or claim under this Agreement; but this Agreement shall be for the sole and exclusive benefit of the Company, the Rights Agent and the registered holders of the Rights Certificates (and, prior to the Distribution Date, the registered holders of the stock certificates for the Common Stock of the CompanyCompany and the Series C Preferred Stock).

Benefits of this Agreement. Nothing in this Agreement shall be construed to give to any Person other than the Company, the Rights Agent and Agent, the registered holders of the Rights Certificates Certificates, (and, prior to the Distribution Date, the registered holders of the stock certificates for the Common Stock Stock) and registered holders of the Company) any security convertible into Common Stock, which holders shall be third party beneficiaries hereof, any legal or equitable right, remedy or claim under this Agreement; but this Agreement shall be for the sole and exclusive benefit of the Company, the Rights Agent and the registered holders of the Rights Certificates (and, prior to the Distribution Date, the registered holders of the stock certificates for the Common Stock of the CompanyStock).

Benefits of this Agreement. Nothing in this Agreement shall be construed to give to any Person other than the Company, the Rights Agent and the registered holders of the Rights Certificates (and, prior to the Distribution DateAgent, the registered holders of the stock Right Certificates (other than those representing Rights that have become null and void) and the certificates for the shares of Common Stock of the Companyrepresenting Rights (other than those Rights that have become null and void) any legal or equitable right, remedy or claim under this Agreement; but , and this Agreement shall be for the sole and exclusive benefit of the Company, the Rights Agent and the Agent, such registered holders of the Rights Right Certificates (and, prior to the Distribution Date, the registered holders of the stock and such certificates for the shares of Common Stock of the Company)representing Rights.
