BIDDER REPRESENTATIONS AND WARRANTIES. 35.1. The Bidder represents that: 35.1.1. The individual signing on behalf of the Bidder is of lawful age and the only one interested in this Bid and that no person, corporation or organization other than the Bidder has any interest in this Bid or in the Contract. 35.1.2. The Bid price has been arrived at independently without collusion, consultation, communication or agreement for the purpose of restricting competition, as to any matter relating to such Bid price with any other Bidder or with any competitor or potential competitor. 35.1.3. Unless otherwise required by law, the prices quoted in this Bid shall not be knowingly disclosed by the Bidder prior to the Bid Opening, directly or indirectly, to any other Bidder or to any competitor. 35.1.4. The Bidder shall not attempt to induce any other person, partnership, corporation or organization to submit or not to submit a Bid for any purpose, including but not limited to restricting competition. 35.1.5. The Bidder shall ensure that no member of the City Council, or other officer, employee or person whose salary is payable in whole or in part from the City Treasury shall be directly or indirectly interested in this Bid or in the supplies, materials, equipment, work or labor to which it relates or in any of the profits thereof. 35.1.6. The Bidder shall not be in arrears to the City upon any debt, contract or taxes. The Bidder shall not be in default, as surety or otherwise, upon any obligations to the City. The Bidder shall not have been declared not responsible, or disqualified by any agency of the City or the State of New York. There is no proceeding pending relating to the responsibility or qualification of this Bidder to receive public contracts except as disclosed by the Bidder in writing as part of and at time of its Bid. 35.1.7. The Bidder shall examine all parts of the Contract Documents and if its Bid is accepted as submitted, this Bidder shall have executed the Contract as set forth herein. 35.1.8. The Bidder shall be duly licensed to do business in the City and the State of New York and the Bidder shall at all times hold or obtain all necessary permits and other authorizations required by law or regulation for performance of the Contract.
