BIDDER’S REPRESENTATIONS. 3.1 In submitting this Bid, Bidder represents that: X. Xxxxxx has examined and carefully studied the Bidding Documents, other related data identified in the Bidding Documents, and the following Addenda, receipt of which is hereby acknowledged: X. Xxxxxx has visited the buildings and become familiar with and is satisfied as to the general, local, and building conditions that may affect cost, progress, and performance of the Work. X. Xxxxxx is familiar with and is satisfied as to all Laws and Regulations that may affect cost, progress, and performance of the Work. X. Xxxxxx has carefully studied all the existing installations. 1. Bidder has considered the information known to Bidder; information commonly known to contractors doing business in the locality of the buildings; information and observations obtained from visits to the buildings; and the Bidding Documents with respect to the effect of such information, observations, and documents on (1) the cost, progress, and performance of the Work; (2) the means, methods, techniques, sequences, and procedures of construction to be employed by Bidder, including applying the specific means, methods, techniques, sequences, and procedures of construction expressly required by the Bidding Documents; and (3) Bidder’s safety precautions and programs. 2. Bidder does not consider that further examinations, investigations, explorations, tests, studies, or data are necessary for the determination of this Bid for performance of the Work at the price(s) bid and within the times required, and in accordance with the other terms and conditions of the Bidding Documents. 3. Xxxxxx is aware of the general nature of work to be performed by Owner and others at that relates to the Work as indicated in the Bidding Documents. 4. Xxxxxx has correlated the information known to Bidder, information and observations from visits to the buildings, reports and drawings identified in the Bidding Documents, and all examinations, investigations, explorations, tests, studies, and data with the Bidding Documents. 5. Bidder has given Owner written notice of all conflicts, errors, ambiguities, or discrepancies that Xxxxxx has discovered in the Bidding Documents, and the written resolution thereof by Owner is acceptable to Bidder. 6. The Bidding Documents are sufficient to indicate and convey understanding of all terms and conditions for the performance of the Work for which this Bid is submitted. 7. Bidder, and all associated subcontractors, will submit written evidence of its authority to do business in the state where the Project is located not later than the date of its execution of Agreement.

Bidder has visited the buildings Site, conducted a thorough, alert visual examination of the Site and adjacent areas, and become familiar with and is satisfied itself as to the general, local, and building Site conditions that may affect cost, progress, and performance of the Work. X. Xxxxxx is familiar with and is has satisfied itself as to all Laws and Regulations that may affect cost, progress, and performance of the Work. X. Xxxxxx has carefully studied all: (1) reports of explorations and tests of subsurface conditions at or adjacent to the Site and all drawings of physical conditions relating to existing surface or subsurface structures at the existing installationsSite that have been identified in the Supplementary Conditions, especially with respect to Technical Data in such reports and drawings, and (2) reports and drawings relating to Hazardous Environmental Conditions, if any, at or adjacent to the Site that have been identified in the Supplementary Conditions, especially with respect to Technical Data in such reports and drawings. 1. Bidder X. Xxxxxx has considered the information known to BidderBidder itself; information commonly known to contractors doing business in the locality of the buildingsSite; information and observations obtained from visits to the buildingsSite; the Bidding Documents; and any Site-related reports and drawings identified in the Bidding Documents Documents, with respect to the effect of such information, observations, and documents on (1) the cost, progress, and performance of the Work; (2) the means, methods, techniques, sequences, and procedures of construction to be employed by Bidder, including applying the specific means, methods, techniques, sequences, and procedures of construction expressly required by the Bidding Documents; and (3) Bidder’s safety precautions and programs. 2. Bidder does not consider X. Xxxxxx agrees, based on the information and observations referred to in the preceding paragraph, that no further examinations, investigations, explorations, tests, studies, or data are necessary for the determination of this Bid for performance of the Work at the price(s) price bid and within the times required, and in accordance with the other terms and conditions of the Bidding Documents. 3. X. Xxxxxx is aware of the general nature of work to be performed by Owner and others at the Site that relates to the Work as indicated in the Bidding Documents. 4. X. Xxxxxx has correlated the information known to Bidder, information and observations from visits to the buildings, reports and drawings identified in the Bidding Documents, and all examinations, investigations, explorations, tests, studies, and data with the Bidding Documents. 5. Bidder has given Owner Engineer written notice of all conflicts, errors, ambiguities, or discrepancies that Xxxxxx Bidder has discovered in the Bidding Documents, and confirms that the written resolution thereof by Owner Engineer is acceptable to Bidder. 6. I. The Bidding Documents are generally sufficient to indicate and convey understanding of all terms and conditions for the performance and furnishing of the Work for which Work. J. The submission of this Bid is submitted. 7. Bidderconstitutes an incontrovertible representation by Xxxxxx that Xxxxxx has complied with every requirement of this Article, and that without exception the Bid and all associated subcontractors, will submit written evidence of its authority to do business prices in the state where Bid are premised upon performing and furnishing the Project is located not later than Work required by the date of its execution of AgreementBidding Documents.

BIDDER’S REPRESENTATIONS. 3.1 In Each Bidder by submitting this Bid, Bidder his Bid represents that: X. Xxxxxx A. He has examined read and carefully studied understands the Bidding Documents, other related data identified Documents and his Bid is made in accordance therewith; and Xxxxxx agrees to be bound by the terms and requirements set forth in the Bidding and Contract Documents; B. He has visited the site, has familiarized himself with the local conditions under which the Work is to be performed in accordance with Article I-9 herein, and has correlated his observations with the requirements of the proposed Contract Documents; C. His Bid is based upon the materials, systems and equipment required by the Bidding Documents without exception; and D. He has the capability, in all respects, and the following Addendamoral and business integrity, receipt reliability, technical ability, financial resources, plant, management, superintendents, equipment and materials which will assure effective and efficient good faith performance in full compliance with the Contract Documents and with any and all schedules and Milestone and Completion dates required by the Owner. The Bidder acknowledges and represents in his estimating, planning and scheduling of which is hereby acknowledged: X. Xxxxxx the Work that the Contract Time has visited the buildings and become familiar with and is satisfied as made allowances for normal inclement weather indigenous to the generalProject Site. The Bidder hereby certifies that the work shall be completed, localin place, in full accordance with the Contract Documents, within the time limits specified. i. He shall employ a competent superintendent who shall be in attendance on site during all construction activities for the execution of the work. The superintendent shall be approved by the Owner, and building conditions shall continue in that may affect cost, progress, and performance capacity on this project for the duration of the Workproject, unless he ceases to be on the Contractor’s payroll or the Owner otherwise agrees. The superintendent shall represent the Contractor and all communication given to the superintendent shall be binding as if given to the Contractor. X. Xxxxxx is familiar with and is satisfied as to all Laws and Regulations Xx agrees that may affect costupon receipt of the Notice of Award, progresshe will execute the Contract, and performance will deliver all bonds and proof of the Work. X. Xxxxxx has carefully studied all the existing installations. 1. Bidder has considered the information known to Bidder; information commonly known to contractors doing business in the locality of the buildings; information and observations obtained from visits to the buildings; and the Bidding Documents with respect to the effect of such information, observations, and documents on (1) the cost, progress, and performance of the Work; (2) the means, methods, techniques, sequences, and procedures of construction to be employed by Bidder, including applying the specific means, methods, techniques, sequences, and procedures of construction expressly insurance coverage as required by the Bidding Documents; and (3) Bidder’s safety precautions and programs. 2. Bidder does not consider that further examinations, investigations, explorations, tests, studies, or data are necessary for F. He agrees to execute the determination Contract within ten (10) buisness days from the date of this Bid for performance Notice of the Work at the price(s) bid and within the times requiredAward, and in accordance case he fails or neglects to appear within the specified time to execute the Contract, he will be considered as having abandoned the Contract, and any Bid Security accompanying this Proposal will be forfeited to the Owner by reason of such failure on the part of the Bidder. X. Xx has made a “good faith effort” to meet New Hanover County School’s verifiable ten percent (10%) goal for participation by minority businesses in the total value of the work. The Bidder shall identify on its bid the minority businesses that it will use on the project. The Bidder shall submit along with the other terms bid an affidavit listing the “good faith efforts” it has made pursuant to subsection (f) of G.S. 143-128.2 and conditions the total dollar value of the Bidding Documents. 3. Xxxxxx is aware of the general nature of work to bid that will be performed by Owner and others at the minority businesses. A bidder that relates to the Work as indicated in the Bidding Documents. 4. Xxxxxx has correlated the information known to Bidder, information and observations from visits to the buildings, reports and drawings identified in the Bidding Documents, and performs all examinations, investigations, explorations, tests, studies, and data with the Bidding Documents. 5. Bidder has given Owner written notice of all conflicts, errors, ambiguities, or discrepancies that Xxxxxx has discovered in the Bidding Documents, and the written resolution thereof by Owner is acceptable to Bidder. 6. The Bidding Documents are sufficient to indicate and convey understanding of all terms and conditions for the performance of the Work for which work under the contract with its own workforce may submit an affidavit to that effect in lieu of the aforementioned affidavit otherwise required under this Bid is submittedsubsection. 7. Bidder, and all associated subcontractors, will submit written evidence of its authority to do business in the state where the Project is located not later than the date of its execution of Agreement.

Bidder has carefully studied all the existing installations. 1. Bidder has considered the information known to Bidder; information commonly known to contractors doing business in the locality of the buildings; information and observations obtained from visits to the buildings; and the Bidding Documents with respect to the effect of such information, observations, and documents on all: (1) reports of explorations and tests of subsurface conditions at or contiguous to the Site and all drawings of physical conditions in or relating to existing surface or subsurface structures at or contiguous to the Site (except Underground Facilities) which have been identified in the Supplementary Conditions as provided in paragraph 4.03 of the General Conditions, and (2) reports and drawings of a Hazardous Environmental Condition, if any, which has been identified in the Supplementary Conditions as provided in paragraph 4.05 of the General Conditions. E. Bidder has obtained and carefully studied (or assumes responsibility for having done so) all additional or supplementary examinations, investigations, explorations, tests, studies and data concerning conditions (surface, subsurface and Underground Facilities) at or contiguous to the Site which may affect cost, progress, and or performance of the Work; (2) Work or which relate to any aspect of the means, methods, techniques, sequences, and procedures of construction to be employed by Bidder, including applying the specific means, methods, techniques, sequences, and procedures of construction expressly required by the Bidding Documents; Documents to be employed by Bidder, and (3) Bidder’s safety precautions and programsprograms incident thereto. 2. F. Bidder does not consider that any further examinations, investigations, explorations, tests, studies, or data are necessary for the determination of this Bid for performance of the Work at the price(s) bid and within the times required, and in accordance with the other terms and conditions of the Bidding Documents. 3. G. Xxxxxx is aware of the general nature of work to be performed by Owner OWNER and others at the Site that relates to the Work as indicated in the Bidding Documents. 4. H. Xxxxxx has correlated the information known to Bidder, information and observations obtained from visits to the buildingsSite, reports and drawings identified in the Bidding Documents, and all additional examinations, investigations, explorations, tests, studies, and data with the Bidding Documents. 5. Bidder I. Xxxxxx has given Owner ENGINEER written notice of all conflicts, errors, ambiguities, or discrepancies that Xxxxxx has discovered in the Bidding Documents, and the written resolution thereof by Owner ENGINEER is acceptable to Bidder. 6. J. The Bidding Documents are generally sufficient to indicate and convey understanding of all terms and conditions for the performance of the Work for which this Bid is submitted. 7. BidderK. No officer, agent, or employee of the OWNER is personally interested, directly or indirectly, in this Bid and accompanying Contract or the compensation to be paid hereunder. L. This Bid is made without connection with any person, firm, or corporation making a Bid for the same work, and is, in all associated subcontractorsrespects, will submit written evidence of its authority to do business fair and without collusion or fraud. 3.02 Bidder further represents that this Bid is genuine and not made in the state where the Project interest of or on behalf of any undisclosed individual or entity and is located not later than the date submitted in conformity with any agreement or rules of its execution of Agreement.any group, association, organization or corporation; Bidder has not directly or indirectly induced or solicited any other Bidder to submit a false or sham Bid; Bidder has not solicited or induced any individual or entity to refrain from bidding; and Bidder has not sought by collusion to obtain for itself any advantage over any other Bidder or over OWNER.‌

Bidder has considered the information known to Bidder; information commonly known to contractors doing business in the locality of the buildings; information and observations obtained from visits to the buildings; and the Bidding Documents with respect to the effect of such information, observations, and documents on (1) Reports of explorations and tests of subsurface conditions at or contiguous to the site and all drawings of physical conditions in or relating to existing surface or subsurface structures at or contiguous to the site (except Underground Facilities) which have been identified in the Supplementary Conditions as provided in paragraph 4.02 of the General Conditions, and (2) Reports and drawings of a Hazardous Environmental Condition, if any, which has been identified in the Supplementary Conditions as provided in paragraph 4.06 of the General Conditions. F. BIDDER has obtained and carefully studied (or assumes responsibility for having done so) all additional or supplementary examinations, investigations, explorations, tests, studies and data concerning conditions (surface, subsurface, and Underground Facilities) at or contiguous to the site which may affect cost, progress, and or performance of the Work; (2) Work or which relate to any aspect of the means, methods, techniques, sequences, sequences and procedures of construction to be employed by BidderBIDDER, including applying the specific means, methods, techniques, sequences, and procedures of construction expressly required by the Bidding Documents; Contract Documents to be employed by XXXXXX, and (3) Bidder’s safety precautions and programsprograms incident thereto. 2. Bidder X. XXXXXX does not consider that further examinationsany additional examination, investigations, explorations, tests, studies, studies or data are necessary for the determination of this Bid for performance of the Work at the price(sprice (s) bid and within the times required, and in accordance with the other terms and conditions of the Bidding Contract Documents. 3. Xxxxxx X. XXXXXX is aware of the general nature of work Work to be performed by Owner OWNER and others at the site that relates to the Work as indicated in the Bidding Contract Documents. 4. Xxxxxx I. BIDDER has correlated the information known to BidderBIDDER, information and observations obtained from visits to the buildingssite, reports and drawings identified in the Bidding Documents, Contract Documents and all additional examinations, investigations, explorations, tests, studies, studies and data with the Bidding Contract Documents. The location of any new sanitary sewer facilities may be adjusted depending on the final field location of any existing utilities. 5. Bidder X. XXXXXX has given Owner ENGINEER written notice of all conflicts, errors, ambiguities, ambiguities or discrepancies that Xxxxxx XXXXXX has discovered in the Bidding Contract Documents, and the written resolution thereof by Owner ENGINEER is acceptable to BidderBIDDER. 6. The Bidding Documents are sufficient to indicate and convey understanding of all terms and conditions for the performance of the Work for which this Bid is submitted. 7. Bidder, and all associated subcontractors, will submit written evidence of its authority to do business in the state where the Project is located not later than the date of its execution of Agreement.

Bidder has considered acknowledges that such reports and drawings are not Contract Documents and may not be complete for Bidder’s purposes. Bidder acknowledges that Owner and Engineer do not assume responsibility for the accuracy or completeness of information known to Bidder; information commonly known to contractors doing business and data shown or indicated in the locality of the buildings; information and observations obtained from visits to the buildings; and the Bidding Bid Documents with respect to Underground Facilities at or contiguous to the effect of Site. X. Xxxxxx has obtained and carefully studied (or assumes responsibility for having done so) all such informationadditional or supplementary examinations, observationsinvestigations, explorations, tests, studies, and documents on data concerning conditions (1surface, subsurface, and Underground Facilities) at or contiguous to the Site or otherwise which may affect cost, progress, and performance performance, or furnishing of the Work; (2) Work or which relate to any aspect of the means, methods, techniques, sequences, and procedures of construction to be employed by Bidder, including applying the specific means, methods, techniques, sequences, Bidder and procedures of construction expressly required by the Bidding Documents; and (3) Bidder’s safety precautions and programsprograms incident thereto. 2. Bidder X. Xxxxxx does not consider that further any additional examinations, investigations, explorations, tests, studies, or data are necessary for the determination of this Bid for performance performing and furnishing of the Work at the price(s) bid and within the times required, and in accordance with the times, price, and other terms and conditions of the Bidding Contract Documents. 3. X. Xxxxxx is aware of the general nature of work to be performed by Owner and others at the Site that relates to the Work for which this Bid is submitted as indicated in the Bidding Contract Documents. 4. Xxxxxx H. Bidder has correlated the information known to Bidder, information and observations obtained from visits to the buildingsSite, reports reports, and drawings identified in the Bidding Contract Documents, and all additional examinations, investigations, explorations, tests, studies, and data with the Bidding Contract Documents. 5. I. Bidder has given Owner Engineer written notice of all conflicts, errors, ambiguities, or discrepancies that Xxxxxx Bidder has discovered in the Bidding Contract Documents, and the written resolution thereof by Owner Engineer is acceptable to Bidder. 6. J. The Bidding Contract Documents are generally sufficient to indicate and convey understanding of all terms and conditions for the performance of performing and furnishing the Work for which this Bid is submitted. 7. Bidder, K. This Bid is genuine and all associated subcontractors, will submit written evidence of its authority to do business not made in the state where interest of or on behalf of any undisclosed person, firm, or corporation and is not submitted in conformity with any agreement or rules of any group, association, organization, or corporation; Bidder has not directly or indirectly induced or solicited any other Bidder to submit a false or sham bid; Bidder has not solicited or induced any person, firm, or a corporation to refrain from bidding; and Bidder has not sought by collusion to obtain for himself any advantage over any other Bidder or over Owner. L. Bidder will perform the Project is located not later than the date of its execution of AgreementWork in compliance with all applicable trench safety standards set forth in Occupational Safety and Health Administration (OSHA) Part 1926 – Subpart P – Excavations.

Bidder has given Owner written notice of all conflicts, errors, ambiguities, or discrepancies that Xxxxxx has discovered in the Bidding Documents, and the written resolution thereof by Owner is acceptable to Bidder. 6. The Bidding Documents are sufficient to indicate and convey understanding of all terms and conditions for the performance of the Work for which this Bid is submitted. 7. Bidder, and all associated subcontractors, will submit written evidence of its authority to do business in the state where the Project is located not later than the date of its execution of Agreement. 8. Bidder is aware of the required certifications that must be held by bidder’s staff and agrees the staff assigned to work on this project will meet the required levels of certifications.

XXXXXX accepts the information known to Bidder; information commonly known to contractors doing business determination set forth in the locality Paragraph SC-4.02 of the buildings; Supplementary Conditions of the extent of the "technical data" contained in such reports and drawings upon which BIDDER is entitled to rely as provided in Paragraph 4.02 of the General Conditions. f. XXXXXX acknowledges that such reports and drawings are not Contract Documents and may not be complete for BIDDER's purposes. g. XXXXXX acknowledges that OWNER and ENGINEER do not assume responsibility for the accuracy or completeness of information and observations obtained from visits to the buildings; and data shown or indicated in the Bidding Documents with respect to existing Underground Facilities at or contiguous to the effect of site. h. Bidder has given Owner Engineer written notice of all conflicts, errors, ambiguities, or discrepancies that Xxxxxx Bidder has discovered in the Bidding Documents, and confirms that the written resolution thereof by Owner Engineer is acceptable to Bidder. 6. I. The Bidding Documents are generally sufficient to indicate and convey understanding of all terms and conditions for the performance and furnishing of the Work for which Work. J. The submission of this Bid is submitted. 7. Bidderconstitutes an incontrovertible representation by Xxxxxx that Xxxxxx has complied with every requirement of this Article, and that without exception the Bid and all associated subcontractors, will submit written evidence of its authority to do business prices in the state where Bid are premised upon performing and furnishing the Project is located not later than Work required by the date of its execution of AgreementBidding Documents.

X. Xxxxxx is aware of the general nature of work to be performed by Owner and others at the Site that relates to the Work as indicated in the Bidding Documents. 4. X. Xxxxxx has correlated the information known to Bidder, information and observations from visits to the buildings, reports and drawings identified in the Bidding Documents, and all examinations, investigations, explorations, tests, studies, and data with the Bidding Documents. 5. Bidder has given Owner Engineer written notice of all conflicts, errors, ambiguities, or discrepancies that Xxxxxx Bidder has discovered in the Bidding Documents, and confirms that the written resolution thereof by Owner Engineer is acceptable to Bidder. 6. H. The Bidding Documents are generally sufficient to indicate and convey understanding of all terms and conditions for the performance and furnishing of the Work for which Work. I. The submission of this Bid is submitted. 7. The Bidding Documents submission of this Bid constitutes an incontrovertible representation by Bidder that Bidder has complied with every requirement of this Article, and that without exception the Bid and all prices in the Bid are sufficient to indicate premised upon performing and convey understanding of all terms and conditions for the performance of furnishing the Work for which this Bid is submittedrequired by the City. 7. Bidder has correlated the information known to Bidder, information and observations obtained from visits to the site, reports and drawings identified in the Contract Documents and all additional examinations, investigations, explorations, tests, studies and data with the Contract Documents. X. Xxxxxxx understand that Owner reserves the right to reject any or all Bids, or parts thereof or items therein, and to waive technicalities required for the best interest of the Owner. Omission of any information may be sufficient cause for rejection of this Bid. It is understood that competency and responsibility of bidders will receive due consideration before the award of the Contract K.
