Bidder has considered the information known to Bidder; information commonly known to contractors doing business in the locality of the buildings; information and observations obtained from visits to the buildings; and the Bidding Documents with respect to the effect of such information, observations, and documents on (1) the cost, progress, and performance of the Work; (2) the means, methods, techniques, sequences, and procedures of construction to be employed by Bidder, including applying the specific means, methods, techniques, sequences, and procedures of construction expressly required by the Bidding Documents; and (3) Bidder’s safety precautions and programs. 2. Bidder does not consider that further examinations, investigations, explorations, tests, studies, or data are necessary for the determination of this Bid for performance of the Work at the price(s) bid and within the times required, and in accordance with the other terms and conditions of the Bidding Documents. 3. Xxxxxx is aware of the general nature of work to be performed by Owner and others at that relates to the Work as indicated in the Bidding Documents. 4. Xxxxxx has correlated the information known to Bidder, information and observations from visits to the buildings, reports and drawings identified in the Bidding Documents, and all examinations, investigations, explorations, tests, studies, and data with the Bidding Documents. 5. Bidder has given Owner written notice of all conflicts, errors, ambiguities, or discrepancies that Xxxxxx has discovered in the Bidding Documents, and the written resolution thereof by Owner is acceptable to Bidder. 6. The Bidding Documents are sufficient to indicate and convey understanding of all terms and conditions for the performance of the Work for which this Bid is submitted. 7. Bidder, and all associated subcontractors, will submit written evidence of its authority to do business in the state where the Project is located not later than the date of its execution of Agreement.

Bidder does not consider X. Xxxxxx agrees, based on the information and observations referred to in the preceding paragraph, that no further examinations, investigations, explorations, tests, studies, or data are necessary for the determination of this Bid for performance of the Work at the price(s) price bid and within the times required, and in accordance with the other terms and conditions of the Bidding Documents. 3. X. Xxxxxx is aware of the general nature of work to be performed by Owner and others at the Site that relates to the Work as indicated in the Bidding Documents. 4. X. Xxxxxx has correlated the information known to Bidder, information and observations from visits to the buildings, reports and drawings identified in the Bidding Documents, and all examinations, investigations, explorations, tests, studies, and data with the Bidding Documents. 5. Bidder has given Owner Engineer written notice of all conflicts, errors, ambiguities, or discrepancies that Xxxxxx Bidder has discovered in the Bidding Documents, and confirms that the written resolution thereof by Owner Engineer is acceptable to Bidder. 6. I. The Bidding Documents are generally sufficient to indicate and convey understanding of all terms and conditions for the performance and furnishing of the Work for which Work. J. The submission of this Bid is submitted. 7. Bidderconstitutes an incontrovertible representation by Xxxxxx that Xxxxxx has complied with every requirement of this Article, and that without exception the Bid and all associated subcontractors, will submit written evidence of its authority to do business prices in the state where Bid are premised upon performing and furnishing the Project is located not later than Work required by the date of its execution of AgreementBidding Documents.

BIDDER’S REPRESENTATIONS. 3.1 In Each Bidder by submitting this Bid, Bidder his Bid represents that: X. Xxxxxx A. He shall employ a competent superintendent who shall be in attendance on site during all construction activities for the execution of the work. The superintendent shall be approved by the Owner, and building conditions shall continue in that may affect cost, progress, and performance capacity on this project for the duration of the Workproject, unless he ceases to be on the Contractor’s payroll or the Owner otherwise agrees. The superintendent shall represent the Contractor and all communication given to the superintendent shall be binding as if given to the Contractor. X. He agrees to execute the determination Contract within ten (10) buisness days from the date of this Bid for performance Notice of the Work at the price(s) bid and within the times requiredAward, and in accordance case he fails or neglects to appear within the specified time to execute the Contract, he will be considered as having abandoned the Contract, and any Bid Security accompanying this Proposal will be forfeited to the Owner by reason of such failure on the part of the Bidder. X. Xx has made a “good faith effort” to meet New Hanover County School’s verifiable ten percent (10%) goal for participation by minority businesses in the total value of the work. The Bidding Documents are sufficient to indicate and convey understanding of all terms and conditions for the performance of the Work for which work under the contract with its own workforce may submit an affidavit to that effect in lieu of the aforementioned affidavit otherwise required under this Bid is submittedsubsection. 7.
