Trade Contractor A Subcontractor who furnishes and installs materials according to the plans and specifications of this Project but does not include one who merely furnishes materials. See 1.1.9.49.
Trade Controls DXC and Supplier will comply with all applicable export, import and trade-related laws and regulations of the United States and other nations. To this effect, Supplier warrants that: (i) if necessary and upon DXC’s request, it will provide DXC with technical specifications concerning commodities, software, technology or services covered by this agreement sufficient for DXC to determine the appropriate export and import classification of such items under applicable regulations; (ii) to the best of the Supplier’s knowledge, the Supplier is not listed on any U.S. Government international trade sanctions lists and that Supplier will give immediate notice to DXC in the event that it is so listed; and
Settlement of Transactions 1. The Company shall proceed to a settlement of all transactions upon execution of such transactions.
Global Trade compliance Products and services provided under these terms are for Customer’s internal use and not for further commercialization. If Customer exports, imports or otherwise transfers products and/or deliverables provided under these terms, Customer will be responsible for complying with applicable laws and regulations and for obtaining any required export or import authorizations. HP may suspend its performance under this Agreement to the extent required by laws applicable to either party.
Trade Compliance Each Party shall comply with all applicable export control and economic sanctions laws and regulations, in the performance of this Purchase Order, including the use and transfer of any Products or Services subject to this Purchase Order.
Free Trade Commission 1. The Parties hereby establish the Free Trade Commission, comprised of ministerial level officials of the Parties or their appointees with the same decision ability, as set out in Annex 11 (Free Trade Commission). 2. The Commission shall: (a) oversee the fulfillment and correct application of the provisions of this Agreement; (b) evaluate the achieved results in the application of this Agreement; (c) oversee the further elaboration of this Agreement; (d) seek to resolve disputes that may arise regarding the interpretation or application of this Agreement, in accordance with Chapter 15 (Dispute Settlement); (e) supervise the work of all Committees and Working Groups established under this Agreement and recommend appropriate actions; (f) consider and make decisions on issues referred to it by the Committees and Working Groups established under this Agreement or by either Party; (g) establish the amount of remuneration and expenses that will be paid to Panelists; and
PROHIBITION ON CONTRACTS WITH COMPANIES BOYCOTTING ISRAEL CERTIFICATION As required by Chapter 2271 of the Texas Local Government Code the Contractor must verify that it 1) does not boycott Israel; and 2) will not boycott Israel during the term of the Contract. Pursuant to Section 2271.001, Texas Government Code:
Authorization of Transaction The Buyer has full power and authority (including full corporate power and authority) to execute and deliver this Agreement and to perform its obligations hereunder. This Agreement constitutes the valid and legally binding obligation of the Buyer, enforceable in accordance with its terms and conditions.
BANK’S RECORD OF TRANSACTIONS The Bank’s record of transactions in respect of and in connection with the use and operation of TBS is conclusive and binding on the Account Holder for all purposes whatsoever save for any manifest error or clerical error but nothing herein shall preclude the Bank from rectifying at any time any error, irregularity or omission therein.
Domestic Iron and Steel Certification Pursuant to Sections 2252.201-2252.205 of the Government Code, Service Provider certifies that it is in compliance with the requirement that any iron or steel product produced through a manufacturing process and used in the project is produced in the United States.
