Binding Covenant. The covenant and rights set forth in this Agreement will run with the title to the lands described in Exhibit “B” and the benefits and burdens hereof will bind and inure to the benefit of all successors in interest to the parties hereto.
Binding Covenant. This Agreement and the dedication of gas owned or controlled by Redwood from the AMI in the Gas Purchase Agreement shall be a real covenant running with the land. Any assignment by Redwood shall be made expressly subject to the terms and conditions of this Agreement.
Binding Covenant. The Owners hereby grant this Environmental Covenant to the NDEP, and declare that the Mohave Site Property, as described in Exhibit “A” hereto, shall herein after be bound by, held, sold, and conveyed subject to the following requirements set forth in paragraphs 1 through 15 herein, which shall run with the Mohave Site Property in perpetuity and shall be binding on the Owners and all parties having any right, title or interest in the Mohave Site Property, or any part thereof, its heirs, successors and assigns, and any persons using the land, as described herein. As used in this Environmental Covenant, the term “the Owners” means any record owner or owners of the Mohave Site Property and, if any, any other person or entity otherwise legally authorized to make decisions regarding the transfer of the Mohave Site Property or placement of encumbrances on the Mohave Site Property, other than by exercise of eminent domain.
Binding Covenant. The provisions of this Agreement will be a covenant which runs with the land and is binding on the Developer, its heirs, successors and assigns. In the event that the Developer assigns this RFA to more than one successor, the Commission reserves the right to require a new or amended RFA for each successor.
Binding Covenant. Xxxx Xxxxxx'x signature to this agreement represents and warrants that this Agreement will be binding and enforceable against the corporation.
Binding Covenant. The provisions of this Agreement shall operate as a covenant running with all parcels of land above described and shall bind both parties hereto and their respective successors and assigns.
Binding Covenant. The provisions of this Agreement shall be a covenant which runs with the lands and is binding on the Developer, its heirs, successors and/or assigns. In the event that the Developer assigns this Agreement to more than one successor, the City reserves the right to require a new or amended Agreement for each successor.
Binding Covenant. 61. This Agreement and the rights granted hereunder are and shall be of the same force and effect, to all intents and purposes, as a covenant running with the Road Allowances. The provisions of this Agreement, including all of the covenants and conditions herein shall extend, be binding upon and enure to the benefit of the County, Jericho and their respective successors and permitted assigns as the case may be.
Binding Covenant. Notwithstanding any other provision herein, the Agreement shall be binding upon and inure to the benefit of the Parties and their respective heirs, devisees, legal representatives, successors, and assigns, and shall constitute a covenant running with the Lands, Leases, and interests covered hereby.
