Binding Effect and Benefit. The provisions of this Agreement shall be binding upon and shall inure to the benefit of the successors and assigns of TBOP and the executors, personal representatives, surviving spouse, heirs, devisees, and legatees of the EMPLOYEE. TBOP may assign this Agreement in the event of a sale, merger, consolidation or transfer of all or substantially all of its business and assets.
