Common use of Binding Effect on Final Settlement Class Members Clause in Contracts

Binding Effect on Final Settlement Class Members. Except for those Settlement Class Members who exclude themselves in compliance with the procedures set forth above, all Settlement Class Members will be deemed to be Final Settlement Class Members for all purposes under this Settlement Agreement; will be bound by the terms and conditions of this Settlement Agreement, the Final Approval Order, the Judgment, and the releases set forth herein; and, except as provided in Section VI.C, below, will be deemed to have waived all objections and opposition to the fairness, reasonableness, and adequacy of the settlement.

Binding Effect on Final Settlement Class Members. Except for those Settlement Class Members members who exclude themselves in compliance with the procedures set forth above, all Settlement Class Members members will be deemed to be Final Settlement Class Members members for all purposes under this Settlement Agreement; will be bound by the terms and conditions of this Settlement Agreement, the Final Approval Order, the Judgment, and the releases set forth herein; and, except as provided in Section paragraph VI.C, below, will be deemed to have waived all objections and opposition to the fairness, reasonableness, and adequacy of the settlement.
