Common use of Binding Nature; Entire Agreement Clause in Contracts

Binding Nature; Entire Agreement. Pathnet and Incumbent acknowledge that (i) each has read and understands the terms and conditions of this Agreement and agrees to be bound by such terms and conditions, (ii) this Agreement shall be binding on each of Pathnet and Incumbent and their respective successors and assigns, (iii) this Agreement is the complete and conclusive statement of the agreement between the Parties, (iv) this Agreement supersedes any and all prior agreements and arrangements between the Parties and all understandings and agreements, oral and written, heretofore made between Incumbent and Pathnet are merged in this Agreement which alone, fully and completely expresses their agreement on the subject matter of this Agreement and (v) this Agreement sets forth the entire agreement on the subject matter hereof.
