Common use of Binding of Successors, Assigns Clause in Contracts

Binding of Successors, Assigns. Subject to the further provisions of this Agreement, the terms and provisions of this Agreement shall be binding upon and inure to the benefit of the Town Parties and Developer and their respective successors and assigns. The parties agree that the terms of this Agreement shall not merge into the Deed.
