Common use of BINDINGEFFECT Clause in Contracts

BINDINGEFFECT. Forwarding this Agreement to the Allottee/s by the Promoter/Developer does not create a binding obligation on the part of the Promoter/Developer or the Allottee/s until, firstly, the Allottee/s sign and delivers this Agreement with all the schedules along with the payments due as stipulated in the Payment Plan within 30 (thirty) days from the date of receipt by the Allottee/s and secondly, appears for registration of the same before the Additional District Sub-Registrar Sonarpur/ D.S.R. Alipore South- 24 Parganas, South-24 Parganas, as and when intimated by the Promoter/Developer, then the Promoter/Developer shall serve a notice to the Allottee/s for rectifying the default, which if not rectified within 30 (thirty) days from the date of its receipt by the Allottee/s, application of the Allottee/s shall be treated as cancelled and all sums deposited by the Allottee/s in connection therewith excluding the Booking Amount amounting to Rs. only and GST (as applicable) accrued thereupon shall be returned to the Allottee/s without any interest or compensation whatsoever.

Alipore South- 24 Parganas– IV at Alipore, South-24 Parganas, as and when intimated by the Promoter/Developer, then the Promoter/Developer shall serve a notice to the Allottee/s Allottee for rectifying the default, which if not rectified within 30 (thirty) days from the date of its receipt by the Allottee/s, application of the Allottee/s Allottee shall be treated as cancelled and all sums deposited by the Allottee/s Allottee in connection therewith excluding the Booking Amount amounting to Rs. /- (Rupees ) only and GST (as applicable) accrued thereupon shall be returned to the Allottee/s Allottee without any interest or compensation whatsoever.

Alipore South- 24 Parganas– IV at Alipore, South-24 Parganas, as and when intimated by the Promoter/Developer, then the Promoter/Developer shall serve a notice to the Allottee/s Allottee for rectifying the default, which if not rectified within 30 (thirty) days from the date of its receipt by the Allottee/s, application of the Allottee/s Allottee shall be treated as cancelled and all sums deposited by the Allottee/s Allottee in connection therewith excluding the Booking Amount amounting to Rs. only 4,43,100/- (Rupees Four Lakh Forty Three Thousand One Hundred only) and GST (as applicable) accrued thereupon shall be returned to the Allottee/s Allottee without any interest or compensation whatsoever.
