Breach and claims. There is breach of contract by the Customer if the Customer fails to fulfil its obligations under the Agreement. In the event of payment default by the Customer, see clauses 4.3 and 4.4. Nevertheless, no breach will exist if the situation is due to circumstances related to the Supplier, or force majeure. The Supplier shall give written notice without undue delay after the breach of contract has been discovered or should have been discovered.
