Common use of BREACH OF CONTRACT BY THE PURCHASER Clause in Contracts

BREACH OF CONTRACT BY THE PURCHASER. If the PURCHASER fails to fulfil any deadlines, terms or conditions of this Agreement, the SELLER shall have the right, to immediately either : 15.1 claim for specific performance by the PURCHASER of his obligations under this agreement by fulfilling all his outstanding obligations under this agreement; 15.2 cancel this agreement by registered letter to the PURCHASER, whereupon the PURCHASER shall forfeit any and all amounts paid to the SELLER or his agent or attorney in terms of this agreement and will vacate the unit immediately without prejudice to any of the other rights and remedies of the SELLER and the right to claim damages; 15.3 should the PURCHASER, however, dispute the right of the SELLER to cancel this agreement and retain occupation of the unit subsequent to the cancellation of this agreement by the SELLER, then the PURCHASER shall, notwithstanding, be obliged to continue to pay the monthly levies and occupational interest referred to in clauses 6 and 11 hereof, as well as to duly fulfil each and every other obligation arising from this agreement until such dispute has been resolved
