BREACH OF CONTRACT ON THE PART OF THE CUSTOMER. 12.1 What is deemed to constitute breach of contract There is breach of contract on the part of the Customer if the Customer fails to perform its duties under the Agreement. Nevertheless, there is no breach of contract if the situation is caused by circumstances related to the Contractor, or by circumstances deemed to constitute force majeure. The Contractor shall submit a complaint without undue delay after the breach of contract has been discovered or ought to have been discovered.
